Increased 1094 and 1095 Penalties on the Horizon

Congress has significantly increased the penalties for failures related to information returns and individual statements required by numerous sections of the Internal Revenue Code, including health care reform's new reporting requirements for health coverage providers and applicable large employers (ALEs) on IRS Forms 1094 and 1095.

U.S. 1st Circuit Court of Appeals Overturns Lower Court Decision Allowing Sexual Orientation Case to Proceed

 

The  U.S. First Circuit Court of Appeals has vacated the decision of a lower U.S. District Court in the jurisdiction of Maine where an employer was awarded summary judgment on a plaintiff's claim for hostile work environment and wrongful termination.

EEO-1 Delayed and VETS-100 Update

  

The website that allows "covered" employers to file their EEO-1 survey online is normally available on July 1. However, the 2015 opening has been delayed for two to three weeks due to technical difficulties. 

 

 

 

 

HR Professional Certification - HRCI or SHRM?

  

Many HR professionals demonstrate their knowledge by earning their PHR or SPHR designations.  Human Resource Certification Institute (HRCI) has provided the exam for this widely recognized designation for over 35 years.  Over the past year, EANE has fielded an influx of questions regarding confusion over the PHR/SPHR designation and the Society of Human Resources Management's (SHRM) new HR professional designations, the SHRM-CP and SHRM-SCP.

The Massachusetts Commission against Discrimination has sided with a Boston College chemistry professor that he was retaliated against following his return from a mental health related medical leave. 

 

 

 

 

MA Delivery Association v. Maura Healy, in her official capacity as Attorney General of the Commonwealth

  

MA Attorney General Maura Healy sought to enforce the MA Independent Contractor Laws (M.G.L. Chapter 149 section 148) against those delivery businesses that are engaged in the practice of employing independent contractors to make "on demand" same day deliveries.
