After much anticipation, the Massachusetts Office of the Attorney General has finally published its regulations on the Massachusetts Sick Leave Law.
Applying to all Massachusetts employers, the sick leave law provided some basic tenets such as to:
- Provide and allow employees to use up to 40 hours of sick time to employees in a calendar year;
- That the time needs to be paid for employers with 11 or more employees; and
- That the time must accrue at a minimum rate of 1 hour for every 30 hours worked.
- That up to 40 hours can be rolled over from one year to the next.
However, numerous questions remained on the finer points of its implementation. Some of these open-ended questions include:
- How would it impact current policies in place?
- How is the 11 employee threshold determined?
- How does the rollover requirement operate?
- How does it impact the accrual and awarding of time in a subsequent year?
- How are paid time off programs impacted in terms of notice, attendance and other issues?
- For unionized employers, will they have open up a union contract and renegotiate any existing sick leave policy that doesn't meet the law's requirements?
What we do know is that law remains on track to go into effect on July 1st so you need to prepare now!
