The New Overtime Rule: Fact and Fiction
The Fair Labor Standards Act (FLSA) of 1938 ensures that all salaried workers are guaranteed overtime pay at time and a half for any hours worked beyond the standard 40-hour workweek. The main aspect of the FLSA is its salary threshold, which says that every employee making under $23,660 annually must be paid overtime (this number has been updated from time to time, most recently in 2004).
DOL's new rule doubles the salary threshold from $23,660 to $47,476. Under this new rule, every full-time, salaried employee making less than $47,476 annually (or $913/week) will now be eligible overtime pay.

On Thursday, August 25th, we will host a Lunch & Learn where employment attorney, William Wells will present the facts of this change. 
  
The learning objectives for this program are:  
  • Identify who will (and will not) be entitled to overtime effective December 1
  • Formulate a plan of action for implementing new overtime practices and policies
  • Recognize and avoid the four common overtime pitfalls

 

Bill Wells is the principal in Wells Law Firm, a labor and employment law firm located in
downtown Oklahoma City. His practice emphasis is on labor and employment litigation.
 
Wells served four years as President of the Oklahoma Employment Lawyers Association, and is an active member of the Oklahoma Bar Association (Evidence Code Committee, Business and Corporate Law Section, Labor and Employment Law Section). He serves as General Counsel for the Central Oklahoma Manufacturers Association, and previously served on the Board of Directors for the Oklahoma Lawyers Association and the Oklahoma Association for Rowing. He is also a proud shareholder in the Green Bay Packers.
 
Wells has presented programs on labor and employment law and trial techniques to legal, business and governmental groups throughout Oklahoma, including the U.S. Equal Employment Opportunity Commission, Oklahoma Judicial Conference, Oklahoma Attorney General, Oklahoma Bar Association, Oklahoma Trial Lawyers Association, Oklahoma State Chamber, Oklahoma Manufacturing Alliance, Central Oklahoma Manufacturers Association, Oklahoma Transit Association and the Canadian Valley, Central, Francis Tuttle, Gordon Cooper, Great Plains, High Plains, Kiamichi, Mid-America, Moore Norman, Pioneer, Pontotoc, Red River and Southern Oklahoma Technology Centers. Seminar topics include: "From the Boardroom to the Courtroom: Labor Litigation Update," "Crossfire: Navigating the ADA, FMLA and Oklahoma's Workers' Compensation Act," and "Breaking News: Using News Media as Evidence at Trial."
 
Wells is admitted to practice before the U.S. District Courts for the Western, Eastern and Northern Districts of Oklahoma, and the Tenth Circuit and Federal Circuit Courts of Appeal. He has handled litigation in the vast majority of Oklahoma's district courts, and has prosecuted and defended claims before the U.S. Equal Employment Opportunity Commission, U.S. Department of Labor, Oklahoma Attorney General Office of Civil Rights Enforcement, Oklahoma Department of Labor, Oklahoma Merit Protection Commission and the Oklahoma Employment Security Commission.
 
Wells is a graduate of the University of Oklahoma College of Law. Prior to moving to Oklahoma to accept a position with the Oklahoma City 89ers Baseball Club, he attended Indiana University. During law school, Wells was a member of the school's Association of Trial Lawyers of America trial competition team and was chosen for the Order of Barristers. Prior to law school, he was a staff writer for The Oklahoman.

Request for Qualifications
The State of Oklahoma, on behalf of the Oklahoma Military Department, is issuing a Request for Qualifications (RFQ) for a new National Guard Readiness Center in Ardmore, Oklahoma with a closing date of 2:00 p.m., September 2, 2016. The Readiness Center will be approximately 83,316 gross square-feet with a cost ceiling limitation of $21.51 million (federal funds). The project will include construction of a new Readiness Center complex, and demolition of approximately 31,874 gross square-feet of off-site existing structures at the legacy Ardmore Readiness Center site. Project award is anticipated to be January 2017 with an estimated project duration of 18 to 24 months.
 
Interested Design-Build teams are invited to request an electronic copy of the RFQ by emailing a statement of interest to ardmoreRC2@olssonassociates.com. In order to submit a response to the RFQ, Design-Build teams must be registered with the State of Oklahoma. Registration instructions and contacts are included in the RFQ.
  
City of Oklahoma City Proposes Ordinance to Establish Traditional Neighborhood Overlay District                   
The City of Oklahoma City Planning Staff has developed a proposed ordinance to establish the Traditional Neighborhood Overlay District.

This ordinance will go in front of the OKC Planning Commission on September 8.
