AGENDA:
Proposed DMA Bylaw changes (effective 10/1/14): Due to administrative and legal requirements and increasing premiums on the employee benefits package, the DMA has discontinued health benefit plans effective 7/1/14. This action was approved and adopted by the body present at our 6/30/14 General Membership Meeting. In consideration of this loss the board proposal includes increased compensation for the 3 titled officers (President, Vice President and Secretary-Treasurer) increased compensation. Please come to the meeting for details.

Section 1. Duties of the President
Section 2. Duties of the Vice President
Section 3. Duties of the Secretary-Treasurer
Section 4. Duties of the Board of Directors

Board commentary on 9/29 DMA Meeting Agenda
Dear DMA Members,
I am writing you on behalf of the DMA Board of Directors. We feel that some explanation is in order regarding the by-law change proposed recently. At our next General Membership Meeting, scheduled at 5:30 p.m., on Monday, September 29th, we will be discussing the proposed pay raises for the three offices of President, Vice-President and Secretary/Treasurer. CLICK HERE for the specific language.

It is necessary to have discussion on this issue, and to vote on this issue, in an open meeting. The usual 3-week notification has gone out, and we look forward to having a good turnout on the 29th. Some members have once again suggested that this is not the best meeting time for them, and have requested a mail-in ballot on this issue. As it turns out, there is no meeting time good for everyone, and we have struggled with that for years. We are also restrained by our by-laws about doing anything but an in-person vote for issues such as the pay-raise.
Please note the following points regarding the proposed pay-raise, which should help clarify our intent and allay your fears that the changes are out-of-line:
  • The number  of hours/per week that each officer will be working is a minimum number.  All of the officers also are required to have a home office, where they also work; and they work outside the office time attending meetings, auditions, etc. The point is they actually work far more hours than it would appear.
  • In addition to their previous pay, each officer received health benefits, which totaled approximately $45,000  additional cost to the DMA in 2013. This benefit is going away and officers will be responsible for their own health care costs in the future.
  • The total cost of healthcare and salaries in 2013 was $142,725. The new costs will be an annual  figure of $120,000. This is a big savings to the DMA!
  • In 2011, President Vriesenga took a voluntary annual salary cut of $10,000+ so that the  DMA could pay a part-time Vice-President. His salary increase now is to bring  his pay into line with the time commitment he has made and continues to make.
Your board of directors has looked long and hard at ways to make the DMA sustainable, including raising dues, cutting costs, and restructuring. We will welcome your comments at the General Membership meeting, and anytime via email (addresses are posted on each weekly bulletin).

As ASO lockout enters its second week with no end in sight, key issues come into focus

With less than two weeks before the opening night of a new season, the musicians of the Atlanta Symphony Orchestra would usually file into Symphony Hall this week with violins and bassoons, trombones and flutes for rehearsals.

Instead, they spent the past week standing outside, holding placards that said, "No More Cuts" and "Excellence not Negotiable," in front of an electronic billboard that advertises concerts that seem less and less likely to happen.

Alcides Rodriguez, a clarinetist who joined the picket one morning at rush hour, said he has already made plans to leave Atlanta to play Mahler's Symphony No. 1 for the New York Philharmonic later this month - one of several ASO musicians who have agreed to perform with other orchestras this fall. "Even if the Atlanta symphony season does start, I won't be here for opening night," he said. "I get the feeling this is going to be a long battle."

NYC jazz musicians fear poverty in retirement
September 17, 2014
By The Associated Press
JONATHAN LEMIRE (Associated Press)

NEW YORK -  (AP) -- Keisha St. John has been singing at some of the most famous jazz clubs in the nation for more than five decades.

She was paid $50 a night when she sang in "Three Guys and a Doll" in 1958. Now, at age 75 and nearing retirement, she has no pension to fall back on -- and is asking the clubs to help out.

"Because jazz is considered the national treasure of America, there should be a greater concern for each musician who has paid a dear price to learn his or her craft," she testified Wednesday in front of the New York City Council. "We demand the just rewards of receiving a pension in our old age."

St. John, several other musicians and a representative of the Associated Musicians of Greater New York Local 802 labor union asked the city council for help. Unlike musicians who appear on Broadway or those who sing at the Metropolitan Opera, jazz singers in New York City don't receive benefits.

"Jazz musicians need pensions," said trumpeter Jimmy Owens, 70. "They need to enjoy the same benefits received by their brother and sister musicians on Broadway and in the symphonic field. The need is real."

To enhance the enjoyment and understanding of Bruch's "Kol Nidrei", we precede it with the traditional version, as sung in synagogues on the evening preceding Yom Kippur, chanted by mezzo-soprano Michal Peer

Despite the great emotional impact made by the chanting of Kol Nidrei, the text is, in fact, a legal disclaimer proclaiming the retraction of all vows that will be made over the coming year

Colorado Springs Philharmonic, 9/21
The season opens this weekend with The Red Violin

This weekend, the Philharmonic is joined by conductor Cristian Macelaru, violinist Philippe Quint, and a magnificent 1708 Stradivarius named Ruby to launch the 2014-15 concert season with two performances of The Red Violin.

The concert features stirring works by three American composers, opening with darkly passionate chords, building with John Corigliano's frenetic explosion from the 1998 film, The Red Violin, and concluding with Copland's euphoric affirmation.

Denver Public Library Concert Series - Taking Applications for 2015

Fresh City Life ConcertsDear Musicians and Friends of Musicians,

As many of you know I am the concert curator for the Fresh City Life Concert Series at Denver Central Library. I've enjoyed working with many of you across the Front Range area doing performances, producing Five Points Jazz Festival and booking our series at the Denver Library. (Those of you new to my newsletter are performers I've worked with...so I hope you don't mind being added to my list so I can keep you updated with gig opportunities and goings-on!)

Fresh City Life is now offering nearly 80 concerts per year (performers are always paid and concerts are always free to the public!) and I am getting ready to book for 2015.

I would love to hear from you if you are interested in performing for us. If you have already submitted recently, please feel free to send me a reminder note now that I am beginning to book. I love having great performers come back and share their latest work with our audiences, so let  me hear about what you are working on this year! Put me on your newsletter lists so I can keep track of you, too!

Write to me at marta@martaburton.com with a brief description of your work and offerings along with a link to your website, current hi-resolution photos and video or audio that represents your music.

I love being a part of this great community of musicians! Please stay in touch!

Marta

P.S. Our recent marketing & copy writing class at the Denver Musicians Association was so thrilling for all of us that we are planning more workshops to help performers book more work, more often! Stay tuned.

AFM Praises Film Incentive Reform Act of 2014
New York, NY- Legislation was introduced today in the U.S. Congress to amend Section 181 of the US tax code that would disqualify producers from obtaining taxpayer money to subsidize their films if US jobs are offshored. Section 181 is currently worth $400 million in yearly subsidies to the motion picture industry.

H.R 5497, the Film Incentive Reform Act of 2014, sponsored by Congressman Collin Peterson (D-MN) and supported by the American Federation of Musicians of the United States and Canada (AFM) would close a loophole in current law which qualifies a film for subsidies if only 75% of a film's production is spent in the US. The AFM has estimated that musicians lose $30 million in salaries each year through offshoring of TV and film music soundtrack jobs.

"There is no justification for Congress to provide corporate welfare to the US film industry when producers take taxpayer money and offshore US jobs," said AFM International President Ray Hair. "Film tax incentive provisions were originally intended to encourage domestic motion picture production, but in the case of musicians who record the film and TV scores, the producers are hurting us."

"Current tax loopholes put hard-working musicians, whose names might not be well-known but who work hard for minimum pay because they love music, at a disadvantage," Congressman Petersen said. The Film Incentive Reform Act of 2014 would close this loophole, ending the tax break to companies that send American jobs offshore. This legislation will save taxpayer money and keep more jobs in the United States," he said.

In 2004, the AFM, in coalition with other entertainment unions and producers, successfully lobbied Congress to include Section 181 in the American Job creation Act of 2004, which outlines "Treatment of Certain Qualified Film and Television Production" for the purposes of providing tax subsidies to domestic film production activities produced in the United States.

Nearly a decade later, Section 181 tax credits provide more than $400 million each year for US film producers. Congressman Peterson's legislation would modify the law to require a subsidized film production to spend 100% of its production costs in the US, effectively keeping taxpayer money at home.

CNN Ordered To 'Make Whole' 300 Union Workers Fired 11 Years Ago

The National Labor Relations Board has ordered CNN to re-hire a hundred former union employees and pay compensation to 200 others to make all the workers whole after illegal anti-union actions eleven years ago. NABET-CWA called on CNN to immediately comply with the NLRB ruling. CNN is required to restore any collective bargaining work that was outsourced. CNN also must recognize the workers' union locals and resume bargaining with them. The NLRB found that CNN had engaged in "widespread and egregious misconduct" and had demonstrated "a flagrant and general disregard for the employees' fundamental rights."

Is Apple's iPhone 6 Ethically Tainted By An Anti-Union Supplier?

The Global union IndustriALL says Apple's new iPhone chips are ethically tainted, coming from NXP Semi-Conductors, an anti-union company that fired all 24 members of the union bargaining committee at its factory in the Philippines. IndiustriALL's Adam Lee spoke with Canada's Radio Labour.

[Adam Lee]: "Apple makes ethical supply chain commitments. It says that it will ensure that worker's rights are upheld in its supply chain. But NXP is a key supplier of Apple. The fact that this company that supplies Apple is committing these fundamental human rights and labor rights abuses - we believe that that creates an ethical flaw in iPhone 6 and a number of Apple products."

Quiet Song for Band- Grade 1/2, by Debbie Davidson.
A great song for the first band concert of the year! It uses the first five notes typically used in band method books, and is inspired by "Bolero." A quiet tune begins with the flutes and then gradually all of the instruments are added for a big climax before it tapers back down to the flutes. Sure to be a crowd-pleaser!

Finale to Beethoven Symphony No. 9- Grade 2+ for full orchestra and SAB chorus, Debbie Davidson.
Arranged to make this amazing classic accessible for middle school students. Key signatures and changes are simplified. Vocal parts are all doubled, and the Baritone part is optional. An advanced part is included for extra support - when this piece was premiered at Cherry Creek Academy, a teacher played this advanced part on the cello and an advanced piano student played it on piano. Most of the second parts (i.e. second clarinet, second flute, second violin) can be handled by students in their second year of instruction. The Cherry Creek Academy performance involved singers, grades 5 - 8, band members, grades 6 - 8, and orchestra members, grades 6-8.
