DMA Boycott of Make Music Denver
|
The DMA Board of Directors is officially boycotting Make Music Denver. This is a formal request of DMA members who are asked not to perform for MMD until this matter is resolved and participating professionals are compensated fairly.
DMA filed a Complaint against MMD on 6/4/2013. As expected, the Colo. Dept. of Labor Response shows that there are few if any legal protections from this form of mass exploitation. The only tool we have is our ability to collectively withhold services.
There's nothing stopping anyone from volunteering their services, even in this example where the Downtown Denver Partnership has more than ample means to pay musicians. Worse yet, DDP defends exploitation of musicians as a valuable community service when in fact their "community service" is undermining an industry.
We also ask non-union musicians to honor this boycott, especially since there is no loss in income nor is there a valid contract to break. We should instead dedicate our time to the true meaning of World Music Day, which is anything but exploitation of musicians.
Thank you for your support! See also: The Good, the Bad and the Ugly Into the Belly of the Beast

Birthday Song's Copyright Leads to a Lawsuit for the Ages
|
By BENJAMIN WEISER
NY Times, Published: June 13, 2013 The song "Happy Birthday to You" is widely credited for being the most performed song in the world. But one of its latest venues may be the federal courthouse in Manhattan, where the only parties may be the litigants to a new legal battle. The dispute stems from a lawsuit filed on Thursday by a filmmaker in New York who is seeking to have the court declare the popular ditty to be in the public domain, and to block a music company from claiming it owns the copyright to the song and charging licensing fees for its use. The filmmaker, Jennifer Nelson, was producing a documentary movie, tentatively titled "Happy Birthday," about the song, the lawsuit said. In one proposed scene, the song was to be performed. But to use it in the film, she was told she would have to pay $1,500 and enter into a licensing agreement with Warner/Chappell, the publishing arm of the Warner Music Group. Ms. Nelson's company, Good Morning to You Productions, paid the fee and entered into the agreement, the suit says.

Nashville's Schermerhorn Symphony Center Headed to Forclosure
|
Auditors question Nashville Symphony's future as an 'ongoing concern'
By Walter F. Roche Jr.
The Tennessean
June 6, 2013
Foreclosure proceedings have been initiated against the Nashville Symphony Orchestra, and an auction of its landmark Schermerhorn Symphony Center has been scheduled for June 28. Formal notice of the foreclosure was issued by Bank of America, the lead lender on the $82.3 million still owed on the concert hall. "The bank group has been in discussions for some time with the orchestra to help it resolve its debt on an acceptable basis and operate at a sustainable level," said Shirley Norton, a spokeswoman with Bank of America. "However, (the Nashville Symphony Association) is in default and has been unwilling or unable to repay the debt. Left with no other alternative the bank group has been forced to file for foreclosure, always a last resort . At the same time, we continue to be in discussions with the Symphony." The notice states that the concert hall will be sold "to the highest bidder for cash, at public outcry." The Symphony could forestall a sale by filing for bankruptcy protection.

19th Annual Summer Course in the Alexander Technique, 7/13
|
The 19th Annual Summer Course in the Alexander Technique at the University of Colorado at Boulder will be held July 8-12, 9:00 to noon daily. A one day Intensive will be held July 13, 1-5:00 pm. The 2012 faculty includes Ed Bilanchone, Amy Likar, and DMA member James Brody. Early registration by DMA members will result in a 15% reduction in tuition.
The Alexander Technique is a powerful tool for changing habits in movement and thinking. While anyone can benefit from this Technique, the work applies especially well to musicians and educators. Participants will learn about generalized and specific body use issues that can affect both performance and educational settings, as well as practical skills for the classroom. The results of a medical study in England that investigated the Alexander Technique were recently published in the British Medical Journal.
A link to a summary of the study and a short film about it can be found at http://www.bmj.com/content/337/bmj.a884 For more information about the Course and the Alexander Technique in general, please consult the following web site: (http://music.colorado.edu/departments/wellness/) or contact DMA member James Brody (brody@colorado.edu).

This Story Stinks
| By DOMINIQUE BROSSARD and DIETRAM A. SCHEUFELE New York Times Published: March 2, 2013 IN the beginning, the technology gods created the Internet and saw that it was good. Here, at last, was a public sphere with unlimited potential for reasoned debate and the thoughtful exchange of ideas, an enlightening conversational bridge across the many geographic, social, cultural, ideological and economic boundaries that ordinarily separate us in life, a way to pay bills without a stamp. Then someone invented "reader comments" and paradise was lost.
The Web, it should be said, is still a marvelous place for public debate. But when it comes to reading and understanding news stories online - like this one, for example - the medium can have a surprisingly potent effect on the message. Comments from some readers, our research shows, can significantly distort what other readers think was reported in the first place.
But here, it's not the content of the comments that matters. It's the tone. In a study published online last month in The Journal of Computer-Mediated Communication, we and three colleagues report on an experiment designed to measure what one might call "the nasty effect." Read On

Ohio Union Members Stand with Fired Teacher Carla Hale

It was her mom's obituary that got Carla Hale fired. The six words sealed the deal? "Survived by Carla & her partner."
Hale, who taught physical education at Bishop Watterson High School in Columbus, Ohio, for 19 years, was fired in March, weeks after the obit ran. Hale said she was fired for being in a gay relationship. Now, local unions represented by the Central Ohio Labor Council are supporting Hale in her fight to be reinstated.

Investigation Launched into Death of Georgia Worker at Kia Supplier
|
By Kenneth Quinnell
6/13/2013
The Occupational Safety and Health Administration (OSHA) has launched an investigation into working conditions at Sewon America's LaGrange, Ga., facility after an employee, Teresa Weaver Pickard, died after allegedly being forced to work in extreme heat. Sewon, a company that provides auto parts to Kia, denies Pickard's death was work-related, but an anonymous source at the plant has disputed Sewon's account of the tragedy.
Michael D'Aquino, an OSHA public affairs officer for the agency's Atlanta-West office, confirmed the investigation, the LaGrange Citizen reports:
"We'll be visiting the [Sewon plant] trying to learn what happened and in what order," D'Aquino said. "We'll be looking at physical evidence as well as talking to eyewitnesses and learning as much as possible about the incident." OSHA also will look at previous reports of misconduct by Sewon, potentially including the 2010 death of a worker who fell 50 feet in a construction accident.

Quiet Song for Band- Grade 1/2, by Debbie Davidson. A great song for the first band concert of the year! It uses the first five notes typically used in band method books, and is inspired by "Bolero." A quiet tune begins with the flutes and then gradually all of the instruments are added for a big climax before it tapers back down to the flutes. Sure to be a crowd-pleaser! $25 Creekside Publishing Company Available mail order through www.creeksidepublishingcompany.com or through Flesher-Hinton. Finale to Beethoven Symphony No. 9- Grade 2+ for full orchestra and SAB chorus, Debbie Davidson. Arranged to make this amazing classic accessible for middle school students. Key signatures and changes are simplified. Vocal parts are all doubled, and the Baritone part is optional. An advanced part is included for extra support - when this piece was premiered at Cherry Creek Academy, a teacher played this advanced part on the cello and an advanced piano student played it on piano. Most of the second parts (i.e. second clarinet, second flute, second violin) can be handled by students in their second year of instruction. The Cherry Creek Academy performance involved singers, grades 5 - 8, band members, grades 6 - 8, and orchestra members, grades 6-8. $65 Creekside Publishing Company Availabe mail order through www.creeksidepublishingcompany.com or through Flesher-Hinton.
