Palm Beach Symphony Is Back In The News Again
December 4, 2012
By Drew McManus
Adaptistration

They say there's no such thing as bad press but the Palm Beach Symphony (PBS) might be testing that adage in the wake of a 12/2/2012 article in the Palm Beach Daily News by Jan Sjostrom that reports the orchestra is once again at the center of a labor controversy. The last time the PBS found itself in the hot seat was toward the end of the 2011-12 season when a proposed Juilliard residency would have displaced most of the orchestra's musicians.

The recent controversy once again focuses on employment practices with the American Federation of Musicians Local 655 alleging that the orchestra has dismissed no less than 75 percent of the musicians without just cause.

The Spokane Symphony musicians and board of directors announced today they have reached an agreement settling a four-week strike.

After a weekend of intense bargaining, the musicians voted Monday night to approve a two-year contract that includes an 11 percent pay cut and three weeks unpaid personal leave. The pay cut comes in the form of reduced guaranteed services, which include rehearsals, concerts and educational events.

The pay cut means core musicians will make about $15,539 a year, down from $17,460, in 160 guaranteed services.

Are There SoundExchange Royalties Waiting For You?
Holiday Party-Meeting Notice As you may know, SOUNDEXCHANGE collects and distributes royalties on the behalf of sound recording copyright owners - record labels and featured artists - for non-interactive digital transmissions, including satellite and Internet radio. Every time a sound recording is used on satellite radio, Internet radio, and cable TV music channels, SOUNDEXCHANGE collects royalties for artists and labels. But despite the organization's best efforts to get royalties into the hands of those who have earned them, more than 50,000 recording artists and labels, including many AFM members, have yet to claim their digital performance royalties.

SOUNDEXCHANGE recently published a list of over 50,000 individuals with unclaimed royalties, and I would like to direct you to that list. If you are a recording artist or member of a self-contained group with tracks that have been used as indicated above, here is how to determine whether royalties are waiting for you.

First, click the following link - http://www.soundexchange.com/performer-owner/does-sx-have-money-for-you/unregistered-artists/ and enter your name, or the name of your act. If you are on the unclaimed list, you will be prompted to register with SOUNDEXCHANGE to begin the process of claiming your royalties.

If you a sound recording copyright owner or record label, as many AFM members are, click the following link - http://www.soundexchange.com/performer-owner/does-sx-have-money-for-you/unregistered-srcos/ and follow the same process as above.

The AFM wants to do everything possible to make sure that members who record and who are sound recording copyright owners know about the possibility of unclaimed royalties. If you have royalties waiting, I'd like to help get the money out of SOUNDEXCHANGE's bank account and into yours.

Best wishes for a happy and healthy holiday season and a productive new year!

Sincerely and fraternally yours,

Raymond M. Hair, Jr.

LCA Logo TIS THE SEASON...    As we approach the holidays, for many of us it's a festive time of year as we look forward to spending time celebrating with our family and friends.  Yet, there are many people in our communities that this time of year is not "happy", "wonderful", "joyous", nor "cheerful".  Each year, Labor's Community Agency asks for help to replenish the Agency's Emergency Assistance Fund, which is primarily used to assist union members, their families, and the community with emergency assistance during time of crisis or need.  Hunger, homelessness, and despair continue to affect our community.  Requests for help continue to be unprecedented with the poor economy and continued job loss and Labor's Community Agency has become overburdened.  You can help... your generosity will make a difference.  Please help us help those in need by contributing to Labor's Community Agency's Annual Emergency Assistance Fund Donation Drive.  Together we can bring hope to those in need!

Help Stop the Threats to Charitable Giving Incentives
Arts Action Fund As Congress and the White House consider various proposals to avoid the impending fiscal cliff scenario of more than $600 billion in federal spending cuts and tax increases for 2013, some have set their sights on limiting the deductions for charitable gifts and possibly even the status of nonprofit organizations as an answer.  In particular, we are deeply troubled by reports of proposals under consideration that would create an aggregate dollar limit or percentage cap for all itemized deductions as a potential short-term revenue solution during the lame duck session.

Over the past 18 months, Americans for the Arts has intensified its outreach to Congress on the detrimental impact that these policies would have on thousands of nonprofit organizations across the country and, more importantly, the communities and individuals that they serve.  In addition to lobbying on this issue during our own Arts Advocacy Day conferences for the last few years, we are actively working with Independent Sector and its diverse network of nonprofit organizations, ranging from American Cancer Society and YMCA to Catholic Charities and The Nature Conservancy. Together, we have lobbied dozens of congressional offices, sent letters (including one today) to the president, and ran ads in major political newspapers, with another new ad coming out this month.

Because of the importance of this issue, a new Charitable Giving Coalition has also emerged, in which Americans for the Arts is a member.  Today, December 5, hundreds of nonprofit groups will lobby together for "Protect Giving - DC Days."  Americans for the Arts will be leading one of these delegations.  It doesn't stop there.  We need our grassroots advocates to participate as well.

YOU can ensure that your voice of support for the arts and the nonprofit sector is heard by your congressional delegation as they consider these issues in this lame duck session. Take two minutes to send a customizable message to your members of Congress.

Help us continue this important work by becoming an official member of the Arts Action Fund. If you are not already a member, you can play your part by joining the Arts Action Fund today -- it's free and easy to join.

Michigan Republicans Pass 'Right to Work' for Less Legislation Without Hearings or Input from Residents

Chris Savage is a Michigan-based political writer and owner of Eclectablog. You also can follow him on Facebook and Twitter.

AFL-CIO President Richard Trumka and President Barack Obama spoke out against "right to work" for less legislation yesterday. These types of laws reduce wages and benefits for working families.

Two days ago, I reported that Michigan Republicans, along with Gov. Rick Snyder, were planning on making Michigan the nation's 24th "right to work" for Less (RTWFL) state by the end of the year. The timetable was, apparently, far more aggressive than that. The very next day after Snyder announced RTWFL was "on the table," he held a joint press conference with House Speaker Jase Bolger and Senate Majority Leader Randy Richardville saying that he was asking for the legislation to be passed and that he would sign it into law.

ALEC Myths Dec 4, 2012
Kenneth Quinnell

A new study of proposals from the American Legislative Exchange Council (ALEC) shows that policies the organization promotes do more to harm the economy than help it, despite the claims of the group's lead researcher and author, Arthur Laffer. States that are highly rated in ALEC's annual Rich States, Poor States report actually do worse economically than states ALEC rates poorly, according to Selling Snake Oil to the States, by Good Jobs First.

Quiet Song for Band- Grade 1/2, by Debbie Davidson.
A great song for the first band concert of the year! It uses the first five notes typically used in band method books, and is inspired by "Bolero." A quiet tune begins with the flutes and then gradually all of the instruments are added for a big climax before it tapers back down to the flutes. Sure to be a crowd-pleaser!

Finale to Beethoven Symphony No. 9- Grade 2+ for full orchestra and SAB chorus, Debbie Davidson.
Arranged to make this amazing classic accessible for middle school students. Key signatures and changes are simplified. Vocal parts are all doubled, and the Baritone part is optional. An advanced part is included for extra support - when this piece was premiered at Cherry Creek Academy, a teacher played this advanced part on the cello and an advanced piano student played it on piano. Most of the second parts (i.e. second clarinet, second flute, second violin) can be handled by students in their second year of instruction. The Cherry Creek Academy performance involved singers, grades 5 - 8, band members, grades 6 - 8, and orchestra members, grades 6-8.
