Cleveland Orchestra, musicians ratify three-year agreement

Musicians of The Cleveland Orchestra over the weekend ratified a three-year
trade agreement that will be in effect through Aug. 30, 2015.

The agreement covers 102 musicians. It sets minimum weekly compensation,
benefit levels, and other terms and conditions of employment for the
musicians of the orchestra, who are members of Local 4 of the American
Federation of Musicians.

In the first year of the agreement, the minimum weekly salary is set at
$2,333, unchanged from the weekly minimum at the end of the previous
agreement, according to a news release from the orchestra. Increases in the
subsequent years "will set the minimum weekly salary at $2,356 for the
2013-14 season and $2,403 for the 2014-15 season," the orchestra stated.

Orchestra Nova Friday canceled the remaining concerts of its 2012-13 season.

The 28-year-old ensemble, whose negotiations with its musicians had stalled and whose conductor, Jung-Ho Pak, resigned two days before the scheduled season-opening performances, had four sets of concerts remaining, including a new series at the California Center for the Arts Escondido.

With no reasonable hope of a successful outcome to the negotiations and the loss of our conductor, it was virtually impossible to deliver the rest of our season, said orchestra CEO Beverly Lambert in a statement.

Six months of contract negotiations came to a halt in late September when musicians did not agree to managements final offer of cutting the size of the 27-member orchestra in half and hiring the balance of the players on a per-service basis. Previously, Pak had wanted the entire orchestra to be on a per service basis and asked for absolute control over which musicians would be hired and fired.

Workers in contract disputes are more often told to stay home.

WASHINGTON - In his first 30 years as a labor lawyer, Harold Weinrich rarely advised corporate clients to lock unionized workers out of their jobs. In
the last decade, labor law rulings favoring employers have changed his mind.

These days, "the employer is in control," said Weinrich, who counsels employers on labor relations as a Washington-based partner at Jackson Lewis, a top workplace law firm. In lockouts, "the employer sets the time, and the employer sets the duration."

As professional musicians and professional hockey players in the Twin Cities are just learning and as sugar beet processors in northwestern Minnesota have grasped painfully for 14 months, companies and even non-profits are getting more aggressive with take-it-or-leave-it offers.

We musicians of the St. Paul Chamber Orchestra express our profound gratitude to our community for its overwhelming support in light of the difficulties we face in contract negotiations with our interim management. Your letters and standing ovations buoy us through this extremely challenging time. Thank you.

Now, management and the board (the Society) has locked us out, and we want you to know why.

The leadership claims that it has sacrificed its share, and that it's time for us to do our part, yet it fails to acknowledge that we've accepted reductions in compensation, saving our orchestra more than $2 million over the past 10 years. It claims to negotiate in a collaborative manner, yet it has rejected outright, without compromise, our concessionary, money-saving and revenue-raising proposals. It insists that our deficit be erased through additional musician salary cuts (33 percent from our current base salary, not 15 percent), demanding an additional $4.5 million to be taken from us over the next three years. It demands the authority to be able to cut the number of musicians, perhaps from 34 to 28, and to terminate any musician involuntarily whenever it chooses to do so.

At the same time, certain board members, along with other arts partners, raised more than $50 million toward building a new concert hall. And nearly $3 million has been found to buy out 16 musicians identified as 55 years and older.

Clearly, it's not that there isn't enough money, but that our leaders intend it for other purposes.

ENGLEWOOD ARTS PRESENTS continues its 2012-13 Chamber Music of the Masters series on Saturday, November 17 at 2:00p in Hampden Hall (2nd level of the Englewood Civic Center) with a performance by the ever-popular Up Close and Musical ensemble.  This program will showcase the wind instruments of the Colorado Symphony and will be dedicated to the memory of a great friend of Englewood Arts and the Denver arts community in general, Erna Butler. 

Included on the program will be Mozart:  Divertimento in E-flat, K252 for 2 oboes, 2 bassoons, and 2 horns; Stravinsky:  Octet for Wind Instruments; and Beethoven:  Octet in E-flat Major, Opus 103.

Max began his musical education with the Orquesta Sinfonica Juvenil de Costa Rica which allowed him to study with PrincipalOboist Jorge Rodriguez and helped to cultivate a passion for Classical Music and the Oboe. Max arrived in the USA in 1996 at the Loyola University of New Orleans and received his Bachelor of Arts in Music Performance. Max began his professional career performing a season with the Louisiana Philharmonic Orchestra as Assistant Principal Oboist. Max moved to Denver in 2002 in order to pursue his Masters Degree in Music Performance,  He attended the Lamont School of Music at Denver University and graduated in 2004. Max went on a whirlwind tour of the United States and Canada performing The Pirates of Penzance with the London based Carl Rosa Opera Company.

Metropolitan Jazz Orchestra Presents
Every month, MJO features two different high school jazz ensembles in concert at Dazzle! Playing the second and third Monday of each month (with some exceptions), the school plays one set followed by a set from MJO. The big finale includes both bands on stage featuring soloists from both groups. Know Your Rights: State Laws on Employee Time Off to Vote

Federal law does not require that employers allow their workers time off to vote, but the majority of states have at least some level of protection for employees who want to leave work to engage in their civic duty. The specifics vary by state, but in each state, the rules apply to almost every type of workplace. Employers are required to know what the laws are and to provide adequate accommodations, according to the rules of that state. Nearly all of the states allow employers to refuse time off to vote for those employees who have two or three hours off during the time the polls are open (the number of hours varies by state). 

Colorado: Employers must pay for up to two hours of leave for voting.

New York, NY - At its October meeting, the American Federation of Musicians (AFM) International Executive Board announced its endorsement of President Obama for a second term. The board cited the progress Obama has made in appointing members to the National Labor Relations Board who understand the needs of working people; reversing the anti-labor legacy he inherited, including advocating for the Employee Free Choice Act that ensures workers' rights to organize; pushing for the elimination of tax breaks for companies that outsource American jobs; and calling on the rich to pay their fair share of taxes.

Metro Community Band Openings 

Comprised of some Metropolitan State College students and community members, the band under the direction of Gerald Endsley meets on Tuesday evenings from 7-9 P.M. in the King Center Concert Hall on the Auraria campus.  All wind and percussion instruements are welcome and there are no fees, auditions, or chair placements.  The band generaly shares two concerts per semester with other metro ensembles. For more information, call  Mr. Endsley at 303-388-0183 or via email at gendsley@ecentral.com. YOUTH ORCHESTRAS / EDUCATIONAL ENSEMBLES

JOIN YOR! (Youth Orchestra of the Rockies)
This year, in lieu of traditional auditions, the YOR begins the season with two open rehearsals on August 19 and 26, 2012 from 3:00 - 5:30 PM at Ridgeview Classical Schools, 1800 South Lemay Avenue, Fort Collins, CO. No pre-regisration is required for these open rehearsals.

Building on the success of last season's collaborations between the Concert Orchestra and Symphony Orchestra, this
year the two orchestras will combine their efforts even more. Rehearsals will begin with strings, move on to works with some winds, and end with larger orchestral works.

Open rehearsal (August 19 and 26, 2012) schedule:

All music will be supplied, with proper bowings.

A completed medical form is required for participation in open rehearsals. Enrollment forms will be available at open rehearsals and will be due at the first regular rehearsal (September 9, 2012) along with a $25 non-refundable enrollment fee. Tuition is $65 per month (3 payments in Fall semester, 4 in Spring). Scholarships may be available (obtain a form at the check-in desk).

YOR supports school music programs! As part of the enrollment process, we will require confirmation that each musician is participating in her/his instrumental program if one exists. We welcome homeschool students.

 A great song for the first band concert of the year! It uses the first five notes typically used in band method books, and is inspired by "Bolero." A quiet tune begins with the flutes and then gradually all of the instruments are added for a big climax before it tapers back down to the flutes. Sure to be a crowd-pleaser!
