Texas Team Attends National Language Access Summit |
Chief Justice Wallace B. Jefferson, State Court Administrator David Slayton, Travis County District Judge Lora Livingston and four other Texas Judiciary representatives recently concluded a three-day meeting in Houston, Texas that brought together nearly 300 court leaders from 49 states, three territories and the District of Columbia to focus on devising solutions to improve access to justice for litigants with Limited English Proficiency (LEP). The team plans on focusing on efforts to provide resources to courts in the state to fulfill the need for interpreters and to educate county officials and court representatives on the need for providing interpreters. Proposed Rules for Small Claims in Justice Court sent to Supreme Court |
The Supreme Court Advisory Committee (SCAC), which is responsible for advising the Supreme Court on potential rule changes, recently completed its work on the proposed rules for small claims cases handled in justice courts. House Bill 79, which was passed in the special legislative session last summer, abolished the small claims court in each county as of May 1, 2013, and required the Supreme Court to adopt rules to define a small claims case and the rules of civil procedure for those cases. The Supreme Court is directed by that bill to promulgate the rules no later than May 1, 2013. 60 Minutes Focuses on Texas Veterans Court |
The CBS news show "60 Minutes" profiled the Harris County Veterans Court on its program on October 14 (http://tinyurl.com/9vrtn8m). The Harris County Veterans Court, the first of its kind in Texas and one of 100 similar courts in 27 states, began in late 2009 and is now one of seven Veterans Courts in Texas. TexasLawHelp Improves Functionality |
TexasLawHelp.org relaunched on September 20 with a new look and new features.
There are just as many resources and information on the new site. The new website has improved search functionality so that visitors can find the information they need more quickly.

Free Telephonic Interpretation Services |
One of the barriers to a person's guaranteed access to the courts is a person's limited proficiency in English. To help eliminate this barrier, the Office of Court Administration (OCA) has hired two licensed Spanish court interpreters, and contracted with a commercial interpretation service for languages other than Spanish, to provide telephonic interpretation services. The interpretation services are available at no cost to the district and county-level courts for two types of cases: intimate partner violence (this program is known as the Texas Remote Interpreter Project and is funded by a grant from the U.S. Department of Justice, Office on Violence Against Women) and child protection (funded by a grant from the Supreme Court of Texas Children's Commission).

− Judge John Delaney, Senior Judge assigned to the East Texas Cluster Court in Brazos County, has used the services of an OCA staff interpreter for child protection hearings and said, "... I thought it went just fine. Excellent. No criticism."
− Judge Deborah L. Richardson, Travis County Associate Judge (Ret.), has used the services of an OCA staff interpreter for a domestic violence hearing and said, "The process of setting up the remote Spanish interpretation was very easy once we had a speaker phone set up in the courtroom. I was very pleased with the interpretation and the court reporter also reported that she was impressed with the result. This is a wonderful resource."

Clerks and Judges soon to review Annual Statistical Report Information |
Clerks and Judges in the state will soon be mailed a report of their annual statistical information to review prior to its publication in the 2012 Annual Statistical Report for the Texas Judiciary. CIP Audit Function Is Up and Running |
The 82nd Legislature transferred the audit function for the Collections Improvement Program (CIP) from the Comptroller's Office to OCA, effective September 1, 2011. During FY 2012, the CIP Audit department completed nine (9) collection rate reviews and two (2) compliance audits. The rate reviews were conducted for the City of Austin, City of Corpus Christi, City of El Paso, City of Pasadena, City of Waco, Lubbock County, Nacogdoches County, Potter County and Randall County.
The department is currently conducting pre-implementation collection rate reviews for new counties and cities who qualify for the program based on the latest census data. The department is also in the process of conducting a risk assessment for FY 2013 to determine which counties and cities will be audited this fiscal year. Counties and Cities Are Reporting Collection Data to OCA |
Since May 2012, OCA has been working with counties and cities to get complete reporting data for mandatory collection improvement programs across the state. As of September 30th, 15% of participating counties/cities have complete information in the OCA system and another 63% are working with OCA to complete their data. Twenty-seven programs have not yet reported because they are new and not all data is available at this time. OCA greatly appreciates the assistance we have received from the collection improvement staff of all participating counties and cities. |
Case Management Vendor Round Table Held |
OCA hosted its first Case Management Vendor Round Table, inviting all vendors that provide case management systems in Texas to attend. Sixteen different case management vendors attended. At the first meeting, OCA and the vendors discussed how OCA, CUC, TAC and other organizations can team up with the vendor community to assist local counties with issues that we have seen. The main topics at our initial meeting were eFiling integration and the Judicial Council monthly reports. Several good ideas were generated, and OCA and the vendor community will be working together to follow up.
The next vendor round table will be held in Austin and will focus on educating the vendor community on the various activities that a clerk or court coordinator must perform. |
eFiling available in 9 Courts of Appeals |
Electronic Filing (eFiling) continues to grow in Texas. The 7th Court of Appeals (Amarillo) recently mandated that attorneys eFile any document in civil cases, and that clerks and court reporters must file their records electronically. The addition of the 7th Court of Appeals increases the number of intermediate appellate courts allowing eFiling to nine. eFiling is now available in trial courts that cover over 80% of the state's population and is mandatory for filing in the Supreme Court of Texas. 9th Court of Appeals implements TAMES |
The 9th Court of Appeals in Beaumont recently implemented the new appellate case management system (TAMES). The Beaumont court now joins three other Courts of Appeal and the Supreme Court in using the new system. The new system increases the transparency and efficiency of the courts using it. Three additional Courts of Appeal are scheduled to implement TAMES before the end of November. Judicial Committee on Information Technology holds first meeting of FY2013 |
The Judicial Committee on Information Technology (JCIT) met on October 12 in the Supreme Court Courtroom in Austin. JCIT heard updates from NICUSA, the current eFiling vendor, and discussed the anticipated eFiling contract under consideration by OCA. JCIT also discussed the Request for Offers (RFO) recently extended by the Department of Information Resources (DIR) for case management systems. Once DIR completes its review of the proposals (in which JCIT is participating), counties will be able to purchase case management systems from the state contract. Indigent Defense Commission hosts strategic planning session |
The Texas Indigent Defense Commission recently completed two days of strategic planning at Bastrop State Park. The Commission and staff focused on how to continue its progress of providing resources and assistance to counties to improve the quality of criminal indigent defense in Texas. |
FY2013 Indigent Defense Formula Grant Request for Applications released - due December 3 |
On Friday the Indigent Defense Commission released its FY2013 Formula Grant Request for Applications. The formula grant provides funding to eligible counties to help meet the Commission's statutory mandates and to promote Texas counties' compliance with standards adopted by the Commission. Judge Ben Woodward completes service as Chair of Court Reporters Certification Board |
Absent a specially called meeting of the Court Reporters Certification Board (CRCB), Judge Ben Woodward (119th District Court - San Angelo) chaired his last meeting of CRCB on October 12. Judge Woodward was appointed as chair of the Board on December 18, 2006, and has faithfully and diligently served the State of Texas in this capacity since then. OCA expresses its gratitude to Judge Woodward for his past service. The Supreme Court will appoint a replacement chair in the near future. National Association for Court Management Annual Conference coming to San Antonio in 2013 |
The National Association for Court Management's (NACM) 2013 Annual Educational Conference will be held in San Antonio from July 14-18. The conference will focus on Court Management 2.0, a discussion of what the courts must be ready to face as the future requires courts to respond to the changing environment.
