Battle of the Siblings-Should You Get Paid For Caring for Your Parent?

Do you need a Caregiver Agreement? 

Issues seem to come in coordinated waves. The last quarter it was individuals calling me just after they had received horrifying diagnoses.

They did not put together their legal affairs and had to do so under horrible time constraints and fear. This quarter it seems as if one call after another has to do with whether or not my client should get paid for the caregiving and care coordination services they are providing. 

In each case, the parent for whom care is being provided cannot consent to paying the child as he or she is cognitively incapacitated and a sibling holds the purse strings. 

In this situation a Caregiver Agreement is a very useful tool; a formal written contract, between family members will solve this problem. I have drafted many of these for those who to provide meal preparation, medical supervision, bill paying, transportation and other services and who should be paid a fee.
