A Lost Soul
Do you have a person?
I will call her Mary, my first groupie. This woman, despite having to rely on an electric wheelchair and despite being disabled and indigent, managed to make it to five, yes five of my seminars consecutively and traveled 50 miles on buses to get to my Manhattan Beach book signing at 8:00 p.m. on a week night.
She is highly educated with a master's degree in education, but somehow fell through the cracks because she did not have a person.
One month ago, Mary was on her way to my office to sign an advanced health care directive. I agreed to be her agent for health care as she had no person.
Normally, I require an individual to sign a geriatric care management agreement and pay me a retainer before I agree to act as their agent for health care, but not her.
She lived with two older sisters who abused her physically and financially. With her permission, I had called Adult Protective Services, but they were worthless.
When I arrived at my office for our meeting, she was waiting there for me with a stranger. The woman was ashen. This Good Samaritan explained that she accompanied Mary to my office because she seemed disoriented and confused on the bus. That was not the Mary I knew.
When Mary and I began to talk, I noticed that there was something askew. She was not making sense and looked off; there is really no better way of describing it. I sat back for a minute and tried to process this turn of events. I told her that I thought she had a stroke and that I needed to call the paramedics. Sure enough, Mary indeed had a stroke.

President Obama's funding allows further research into stem cell treatment for Alzheimer's
The new funding will also further the National Alzheimer's Project Act mandated by Obama last year and help coordinate efforts to find better ways to prevent and treat the disease, which is currently the sixth leading cause of death in the United States.
Previous studies have shown that stem cells can create and replace brain cells destroyed by Alzheimer's, and the new funding by Obama will allow more clinical trials to continue to investigate stem cell treatments.
Research has established that stem cells have the ability to form many other types of cells, including brain cells and neurons. With further investigation, scientists are hopeful to discover the causes that contribute to the development of disease as well as find better methods to delay, prevent and cure Alzheimer's using stem cell-based therapy.

BEWARE OF TRUST MILLS
They call these Estate Plans? Living Trusts?
Not the ones I've seen lately
In the last two weeks I had to fix three "estate plans" done by trust mills that gave free seminars and charged $600.00 - $900.00 for a plan.
I was able to get one of my client's retainers back for a client. As to the others, there was no chance; one was shut down by the FBI and the other was done in too long ago.
On behalf of my hard working colleagues and I, "Sorry, but you get what you pay for."
It is true that a simple plan should not cost you an arm and a leg. However, how will you know if your plan is simple or not if you do not have someone take the time to sit with you and evaluate your particular needs?
In one of these cases, the husband has dementia, the daughter has metastatic bone cancer, they have a prefabricated home on soil that they rent and an apartment rental unit.
What they brought to me was four pages of garbage. No one sat with them to discuss how to position their assets in the likely event that one of them needed care.
No one brought up that he was entitled to Veterans Aid and Attendance benefits and may need other public assistance.
The other family had a document done for them that stated that it was a restatement and amendment of a trust. However, they never had done a trust before and the entire transaction (including the funding) had to be redone.
Please do not give anyone your money just because they made it cheap. The Bottom Line: Get it done right the first time, or you will be in for major problems later. Feel free to call or email me with any questions.
