MAPCS Legislative Day on the Hill


MAPCS members joined together for a Legislative Day on the Hill on Thursday, May 7, 2015. Approximately 35 members traveled to the State House on Beacon Hill in Boston to educate legislators about the contribution that private career schools make to the Commonwealth's economy and workforce.  

Altogether MAPCS members met with 10 representatives. The Day on the Hill began with a legislative briefing with meeting sponsor Pearson Learning.  After the briefing members met with their local legislator and senator.  During the visits school representatives, their students and employers talked about how schools educate students for career success. Their goal was to show legislators that postsecondary educators with a career focus contribute to the economy. 


 
Some of the specific points made during the legislative visits follow.


 
Private career schools and colleges in Massachusetts:

  • Know that affordable and accessible postsecondary education is the key to student success.
  • Design academic curriculum to align with workplace demands.
  • Contribute to the training of employees with the skills to meet employer demands. 
  • Figure out a ways to design programs that support hard-to-fill jobs.
  • Develop employer-partnership and work to meet market needs to ensure that they are offering programs in the most sought after careers.
  • Produce employees with market specific skills in high demand fields including allied health care, business administration, computer technology, cosmetology, culinary, dental, electronics, legal administration, massage therapy, medical billing & coding, pharmacy, photography and many more.

Update on MAPCS Lawsuit
 

 

MAPCS sued Massachusetts Attorney General Martha Coakley in federal court to challenge as unconstitutional and in conflict with federal law new regulations that target private, for-private colleges.

 

On Friday, May 8, 2015 MAPCS moved for summary judgment against the Attorney General, seeking the issuance or an order essentially setting aside or enjoining from enforcement the subject regulations.  The AG's opposition briefing is due June 5th, the MAPCS reply brief is due June 19th.  A sur-reply from the AG, if needed, would be due June 26th. 

 

The Court set July 15th for a hearing date for oral argument on summary judgment.

State Financial Aid 

 

Requires that public and private colleges and universities, but not community colleges and junior colleges, provide accepted applicants the uniform financial aid information shopping sheet, developed by the Consumer Financial Protection Bureau and the US Department of Education, prior to the institution's enrollment deadline. 

An Act relative to protecting biometric information under the security breach law

Includes biometric information in the types of information falling under the protection of the state's established security breach laws.

An Act protecting student privacy


Grants educational institutions the discretion to limit or prohibit the possession or use of certain personal devices by students on school property.

An Act concerning sexual violence on higher education campuses

Requires in order to receive state funds for student financial assistance, the president of each community college, state college and university, and the president of each individual University of Massachusetts institution, and the governing boards of the independent post-secondary institutions shall adopt policies concerning sexual assault, domestic violence, dating violence, and stalking, as defined in the federal Higher Education Act of 1965.

An Act ensuring uniformity in education discrimination complaint procedures


Permits, within 300 days after the alleged unfair educational practice was committed, any person seeking admission as a student to any educational institution, or enrolled as a student in a vocational training institution, who claims to be aggrieved by an alleged unfair educational practice to independently, or through a parent or guardian, make, sign and file with the Massachusetts Commission Against Discrimination a verified complaint which sets forth the particulars thereof and contain such other information as may be required by the commission.

An Act relative to health care providers and first responders education


Stipulates that no health care provider who is licensed or registered pursuant to the Chapter on Registration of Professions and Occupations shall obtain a license or registration or renewal of said license or registration unless the health care provider has demonstrated that the health care provider has received appropriate training and continuing education on HIV/AIDS counseling and testing, the diagnosis and treatment of HIV disease and infection control and universal precautions.

Requires third party advertising networks to post clear and conspicuous notice about data collection and use practices.

An Act relative to student data privacy

 

 

 

Prohibits any person who provides account-based access to a website or an online service for an educational institution; who marketed and designed the online service for the educational institution; and who has knowledge that the online service collects data related to a student, from using the online service to sell student data or to process student data in furtherance of advertising; except that the online service provider may process student data to provide, improve, develop or maintain the integrity of its online services.

An Act relative to the creation of the battlefield to STEM field incentive program

 

 

 

Establishes a Battlefield to STEM Program to provide financial support to veterans who have completed one year of instruction in a STEM designated course of educational pursuit and have demonstrated academic promise

Requires all postsecondary educational institutions offering courses and programs leading to degrees or certificates to residents of the commonwealth to provide, prior to the institution's enrollment deadline, uniform student financial aid information to every prospective student who has been accepted for admission to the institution.

An Act relative to student's rights in higher education

 

 

 

Requires, prior to any disciplinary hearing to be held by a post secondary public or private educational institution which could result in a student being suspended or expelled, an administrator inform the student that he or she has the right to call his or her parents while in the custody of campus police, and to have an attorney present during any subsequent institutional disciplinary hearing.
