MAPCS Legislative Day on the Hill
Boston, MA
9:00 am - 2:00 pm

Plan to attend the MAPCS May 7th

Day on the Hill.  This is your opportunity to educate legislators about how private career schools educate students for career success and contribute to the Commonwealth's economy and workforce.

Making contact with policy makers is the best way to spread the positive message that private sector colleges and universities and more importantly, their students and graduates, have to share.

MAPCS AG Lawsuit Update
Law

MAPCS filed an amendment to the AG complaint in December. Click here  to read the updated complaint.

The Attorney General has elected to "answer" the complaint, and work with MAPCS to move this case to summary judgment.   This eliminated the rather prolonged process of the Attorney General moving to dismiss with a full briefing and oral argument.

The summary judgment will allow the court to make a decision based on the record, not just what is alleged in the complaint.

MAPCS lawyers are currently working with the Attorney General to identify and hopefully agree upon the record.  That should be done soon, but such timing is contingent on the Attorney General office, which is assembling the "official" record

MAPCS is also working to set a scheduling conference under the federal rules, to get this moving from the perspective of all parties.

When the parties agree upon a summary judgment briefing schedule then this will be submitted to court for approval.

APSCU Legislative News
Supporting Academic Freedom through Regulatory Relief Act

On Friday, February 13, 2015, Chairman Kline (R-MN), Chairwoman Foxx (R-NC), and Congressman Hastings (D-FL) introduced the Supporting Academic Freedom through Regulatory Relief Act (HR 907).

The bill is very similar to HR 2637 introduced in the previous Congress.

APSCU sent letters of support to the House and Senate sponsors of the bill. ACE has also sent a letter in support of the bill.

HR 907 does the following:

  • Provides regulatory relief to the higher education community by repealing regulations related to:
    • Gainful Employment
    • State Authorization
    • Definition of Credit Hour
  • Prohibits the Department of Education from promulgating or enforcing any regulation or rule on the following topics until programs under the Higher Education Act are extended for no less than two years:
    • Gainful Employment
    • State Authorization
    • Teacher Preparation
  • Prohibits the Department from promulgating or enforcing any rule with regards to the Definition of Credit Hour regulation
  • Prohibits the Department from developing, refining, promulgating, publishing, implementing, administering, or enforcing any postsecondary institution ratings system or any similar performance system designed to rate institutions of higher education
  • Allows institutions of higher education to work with third-party servicers and provide payment to those servicers so long as:
    • The third-party servicer is not affiliated with the institution providing payment
    • Servicers provided are in addition to the recruitment of students
    • Personally identifiable information is not sold to or shared with any other person or entity
