Supreme Court to Review Obama Administration's
Secretive Immigrant Visa Denials
SCOTUS to decide if US government can deny visas without explanation despite 9th Circuit ruling in favor of families
San Francisco - Asian Americans Advancing Justice - Asian Law Caucus is disappointed in the Obama administration's continued litigation to separate families and evade review. Earlier today, the United States Supreme Court granted the administration's request to hear Din v. Kerry. Advancing Justice - Asian Law Caucus was co-counsel in this case along with Sidley Austin LLP and has represented Fauzia Din, a U.S. citizen, for the past several years as she seeks to reunite with her husband.
Mrs. Din petitioned her husband for a visa in 2006. After years of delay, the State Department issued a form indicating that it was denying a visa based on unspecified national security grounds and refused to provide a basis for the denial. Her husband served as a payroll clerk in the Ministry of Education for years and had no ties to military service or terrorism.
The State Department has insisted it had the right to deny visas without stating a valid basis. In 2013, the Ninth Circuit Court of Appeals ruled that the State Department was required to provide a legitimate basis for the denial. However, the Obama Administration has continued its efforts to keep the Din family apart, appealing the decision to the Supreme Court.
"The Obama Administration's extraordinary effort to deny Mrs. Din's visa petition is part of a larger issue that presumes all Muslims as a threat to national security. Since September 11th, thousands of families have been separated for years although the government is unable to articulate any specific national security concerns. Seventy years after the Supreme Court's decision upholding Japanese internment in Korematsu v. United States, we continue to profile entire communities as a threat to national security," said Anoop Prasad, Senior Staff Attorney at Advancing Justice - Asian Law Caucus and counsel for Mrs. Din.
