Bill Addresses Problem of Independent Contractors Uninsured For Workers' Compensation

We expect the Unicameral Business & Labor Committee to meet in executive session early this week to consider voting LB 276 onto the floor for debate by the full legislature (General File).

ACTION NEEDED ASAP: 

Please call and/or e-mail Committee member Sen. Jerry Johnson, District 23, and urge him to vote YES to move LB 276 out to General File.

BACKGROUND:
At IIAN's request, LB 276 was introduced by Business & Labor Committee Chairman Burke Harr of Omaha, to address the growing problem of independent contractors who do not insure themselves for workers compensation.

If passed, the bill would provide a procedure in statute to legally certify independent contractors "up front", and clearly exempt Certified Independent Contractors from workers compensation law in Nebraska.

Talking Points:
 

  • It will greatly reduce the current large uninsured exposure that hiring agents (including contractors) and their insurance companies now have, thus reducing serious unanticipated loss and premiums
     
  • It will reduce employee-vs-independent contractor mis-classification and uncertainty about coverage
     
  • LB 276 will not change the definition/status of "employee" in Nebraska
     
  • Certification and regulation will be funded by independent contractor fees, not out of the General Fund
