American Taxpayer Relief Act of 2012

 

To avert the Fiscal Cliff, Congress signed the American Tax Payer Relief Act of 2012 earlier this month. This piece of legislation will bring changes to payroll tax withholding, as well as many employee benefits. Some of these changes include:

  • Extending employer-provided education assistance,
  • Extending monthly tax exclusion for transit and vanpool benefits
  • Permitting participants in contribution retirement plans to elect to transfer amounts to a designated Roth 401(k) account
  • Extending federal emergency unemployment benefits for one year
  • Reinstating and extends the Work Opportunity Tax Credit through 2013
  • Reversing a $600 deduction in the $3,000 credit for child and dependent care.

Many of us are working with staff members who were otherwise not hired for the roles they presently handle, primarily due to the need to consolidate our organizations in light of the changing economic conditions. That has resulted in even a greater need to provide coaching and feedback to our people. A style that focuses on counseling, educating and constructively guiding our team can only help our success, individually and as a group. Find the time to sit with your direct reports and counsel them. It's worth every minute and pays great dividends.

Q: Can we provide different levels of employee benefits to employees in the same company?

In short yes. ERISA guidelines allow you to establishclasses or groups within your organization and treat each group as you see fit so long as you don't violate other employment laws in the process. For example you could make higher wage earners pay more for their coverage (or less). You could draw the lines by title or even by department. Overall it is critical that whatever guidelines are established that you are consistent in your practices. Lastly, when constructing such a plan do so with advice and input of counsel or a professional.
