Only One Week Left to Submit NECF Speaking Proposals
There is only one week left to submit a speaking proposal for GEO's 3rd Annual National Equity Compensation Forum (NECF). We encourage anyone interested in being a part of this year's agenda to submit a proposal soon. The submission deadline is next Friday, 22 March 2013. Francis O'Mahony is Head of Employee Share Plans and Share Registration at BT Group plc responsible for driving forward strategy, communications and administration of the group's UK and global share plans. He has been at BT for nine years. Before this he was a share plans consultant at Mercer's for two years. Before that he was Employee Share Schemes Unit manager at HM Revenue & Customs for six years, including during the introduction of the UK Share Incentive Plan (SIP) and UK EMI legislation.

Second Circuit Applies Rebuttable Presumption That Fiduciaries Were Prudent in Offering Employer Stock for One Retirement Plan but Denies the Presumption to Another Plan
Source: Lexology In Taveras v. UBS AG, No. 12-1662-cv (2d Cir. Feb. 27, 2013), the Second Circuit held that ERISA plan fiduciaries are not entitled to a presumption that they acted prudently by offering plan participants the opportunity to invest in employer stock where the plan's terms merely permit - but do not in the Court's view require or "strongly encourage" - employer stock as a plan investment option. Many federal courts, including the Second Circuit, recognize that under the Moench presumption (named for Moench v. Robertson, 62 F.3d 553 (3d Cir. 1995)), a fiduciary's decision to offer the employer's own stock as an option to retirement plan participants is presumptively prudent under ERISA.

Surveys demonstrate that company stock, on average, is playing a much reduced role in defined contribution plan menus. The latest Pensions & Investments survey of the nation's largest retirement plans shows that among the biggest DC plans, company stock represented a 15.6% allocation as of Sept. 30. Data from previous surveys show an almost steady annual drop from the 24.7% stock allocation in 2006, the year the Pension Protection Act was passed.
