2013 French Finance Act Introduces Additional Significant Changes to Taxation of Qualified (and Non-Qualified) Awards in France
Source: Baker & McKenzie On December 30, 2012, the French Finance Act of 2013 (the "Act") was enacted into law after several provisions of the draft legislation were rejected by the French Constitutional Court. Most notably, the French Constitutional Court struck provisions (i) calling for taxation of French-qualified award income at combined rates up to 79.5%, and (ii) adding a 18% surtax on compensation for high income earners (raising the total tax burden to 75%). In addition, through some technical changes, the Court eliminated the minimum holding period requirement for French-qualified options. MORE
