Greetings Members!!
As summer approaches, everyone seems to get busy and that's no exception for NMUCA. We have lots of events and training coming up and I hope that you have time to join us! Thanks to everyone who attended our last membership meeting with Ron Peterson, Baker-Peterson LLC. It was a great turnout and a very informative presentation. Our next membership meeting is scheduled for June 16th as the Mid-Year-Social will takes place for dinner from 6pm to 9pm at the Albuquerque Country Club. This meeting is a bit different from our regular membership meetings as it's less business and more social and networking. Also, we love to see you bring your spouse, significant other or guest since we'll enjoy dinner and drinks. I hope to see you all there. Plus, we have our annual NMUCA night at Isotopes Park which is always a great crowd and a great time; register early as we always sell out this event. You may have heard about the release of the OSHA Silica Rule. This rule will have a significant impact on our industry and the way that we conduct work. The new rule requires some substantial (and potentially expensive) changes when employees are exposed to silica. The rule is official on June 23, 2016 and will see enforcement by June 23, 2017. There are several national associations that have filed a lawsuit so things may change with an injunction; however, at this time it's recommended that you move forward with compliance. OSHA's New Silica Ruling
|
OSHA has released it's new rule on silica and you should be aware of the new requirements. OSHA has set up a page dedicated to the new rule and you can CLICK HERE to view it. Note that the new rule becomes effective on June 23, 2016 and will be enforced by OSHA on June 23, 2017.
Currently, several industry associations have filed a lawsuit against the new rule. There may or may not be an injunction, so the best way to proceed is to be prepared to be in full compliance. The final rule has a significant impact on the construction industry.

Rule requires engineering controls to keep workers from breathing silica dust
The Occupational Safety and Health Administration (OSHA) has issued a final rule to curb lung cancer, silicosis, chronic obstructive pulmonary disease and kidney disease in America's workers by limiting their exposure to respirable crystalline silica. The rule is comprised of two standards, one for Construction and one for General Industry and Maritime.
OSHA estimates that the rule will save over 600 lives and prevent more than 900 new cases of silicosis each year, once its effects are fully realized. The Final Rule is projected to provide net benefits of about $7.7 billion, annually.
About 2.3 million workers are exposed to respirable crystalline silica in their workplaces, including 2 million construction workers who drill, cut, crush, or grind silica-containing materials such as concrete and stone, and 300,000 workers in general industry operations such as brick manufacturing, foundries, and hydraulic fracturing, also known as fracking. Responsible employers have been protecting workers from harmful exposure to respirable crystalline silica for years, using widely-available equipment that controls dust with water or a vacuum system.
Key Provisions
- Reduces the permissible exposure limit (PEL) for respirable crystalline silica to 50 micrograms per cubic meter of air, averaged over an 8-hour shift.
- Requires employers to: use engineering controls (such as water or ventilation) to limit worker exposure to the PEL; provide respirators when engineering controls cannot adequately limit exposure; limit worker access to high exposure areas; develop a written exposure control plan, offer medical exams to highly exposed workers, and train workers on silica risks and how to limit exposures.
- Provides medical exams to monitor highly exposed workers and gives them information about their lung health.
- Provides flexibility to help employers - especially small businesses - protect workers from silica exposure.
Compliance Schedule
Both standards contained in the final rule take effect on June 23, 2016.
Construction - June 23, 2017, one year after the effective date.
