The Legislative Session is going relatively well so far! We have seen bi-partisan with business and labor support on the proposed changes to the New Mexico Worker's Compensation statute. Hopefully, we will see some improved changes through legislation this year. You should be receiving updates about once a week (usually Mondays). If you're not receiving legislative updates, please email me at jane.nmuca@gmail.com and I'll make sure that you're included on the list. February 21, 2015 marked the last day to drop legislation. There are 1637 pieces of legislation introduced in the this session including 49 House "dummy bills" and 49 Senate "dummy bills." These "dummy bills" are basically blank and are used to introduce legislation after the deadline has passed. The breakdown on legislation is a follows:

Excavation Safety Competent Person Training

Excavation is the most dangerous of all construction operations. More workers are killed or seriously injured in and around excavations than in other phases of construction work, and that's why the Occupational Safety and Health Administration (OSHA) requires a competent person to oversee all excavation and trenching jobsites. The competent person must have specific training in, and be knowledgeable about, soil analysis, the use of protective systems, and the requirements of OSHA Subpart P.

NUCA's Excavation Safety Competent Person Training program helps contractors train the competent person and workers. Although the responsibility for designating a competent person is the sole responsibility of the contractor, this program is designed to simplify the task by providing participants with the information and training needed to become a competent person.

The program includes the scope and application of Subpart P-Excavation Standard; definitions; general requirements; requirements for protective systems; soil classification; and handling an OSHA inspection. Each participant receives a training manual that includes a complete copy of the Excavation Standard.

 2013 BLS Fatality Report

  • Nationwide
    • 4,405 fatalities in 2013¹; down from 4,628 in 2012
    • 3.2 fatal injuries per 100,000 full-time equivalent workers
    • 40% of worker fatalities involved transportation incidents² (22% - roadway incidents / 17% - Other)
    • Fatal work injuries among all major racial/ethnic groups were lower except fatal work injuries among Hispanic or Latino workers were higher in 2013 - up 7%.
  • New Mexico
    • 53 fatalities in 2013; up from 39 in 2012
    • 64% (34 of 53) involved transportation incidents

OSHA's Record Keeping Changes 

OSHA's updated recordkeeping rule expands the list of severe injuries that all employers must report to OSHA. Establishments located in states under Federal OSHA jurisdiction must begin to comply with the new requirements on January 1, 2015; however, since New Mexico has a state plan, the deadline to comply will more than likely be January 1, 2016 according to NMOSHA officials. As a good practice, you are encouraged to starting adhering to the changes now.

New Changes to the NM811 Law 

Changes to the New Mexico 811 Law were finalized in December 2014. NMUCA was involved in these changes earlier in 2014, but it took a little while for the changes to come before the Commission for approval.
