From the Executive Director's Desk
Greetings Members!!

American Flag

Thanks to everyone that attended the last membership meeting with NUCA CEO Bill Hillman! It was a good crowd and very informative on how NUCA is working to promote, protect, and preserve our industry just like we do here in New Mexico. Bill mentioned quite a few membership benefits that you may not be aware of, so there's a list of them below with a link to their webpage.

The most famous words in construction: "It'll be so nice when it's finished." The NUCA of NM office is still a construction zone as the building remodel kicks in to high gear. If you need to come to my office, please enter through the east side door -- the north doors no longer exists! Right now, the project is estimated to be completed by the end of the year, so NUCA of NM meetings will be scheduled at member's offices at least until then. Please note the temporary locations in your meeting notices.

Welcome New Member!

NM811 Proposed Law Changes

On September 24, 2014, I testified before the NM Public Regulation's Committee regarding the proposed changes to the NM One Call Law. NUCA of NM has been involved in discussions through the NM Common Ground Alliance and its stakeholders and is in support of all the proposed changes. It is estimated that the NMPRC will vote on the proposed changes before the end of the year.

To see a pinpointed list of the proposed changes, Click Here, to view the PDF document online. NUCA of NM, and other stakeholders, attest that the proposed changes will enhance the advancement of damage prevention in New Mexico.

Please consider attending the NM Regional Common Ground Alliance meetings as discussions from this group often result in a change in the law or best practices. The next meeting is scheduled for October 30, 2014 at the NM811 office at 11am.
New NUCA of NM Committee
Human Resources Committee

Overwhelmed with human resource issues?
Do you know the steps required and recommended for hiring new employees?
Do you know the steps required and recommended for firing employees?
Do you have question about the  I-9, W-2, W-4, ITIN, etc.?
Are your policies protecting you?
Is your employee handbook complete?

If you pondered the answer to these questions then the NUCA of NM Human Resource Committee might be perfect for you. This committee has recently been formed and includes representatives from several member companies. This committee is the place to share information, share concerns, ask questions, determine best practices, and learn the requirements for all things human resources. New Mexico Department of Transportation Alternative Project Delivery --  For New Mexico Department of Transportation construction and reconstruction projects, alternative project delivery systems may be authorized when the Cabinet Secretary of Transportation and/or the New Mexico Transportation Commission makes a determination in writing that it is appropriate and in the best interest of the state to use the system on a specific project. The alternative project delivery system does not replace the design-bid-build system typically used to deliver the NMDOT program but will be used as a supplemental system for specific projects identified in the program. NUCA ACA WhitePaper - Employer's Obligations  -- After becoming law in 2010 The Patient Protection and Affordable Care Act (ACA) created a web of regulation and requirements that are a challenge for business owners to understand. Businesses must comply with these new requirements or face stiff penalties. This means that employers must be prepared for the coming new requirements of the ACA. There is no substitute to being knowledgeable; putting in the work to familiarize yourself with the law now, will save you time and money in the future.  Read the entire paper here.

VOTE -- As you know, early voting has already started and election day is only a couple of weeks away. Sometimes, there's more on the ballot than we might expect and this year is no different. There are lots of judges up for retention and also a few NM Constitutional Amendments. For your convenience, please use the links below to ease your voting experience:

Crane Law

  • This is a NEW OSHA directive for agency compliance personnel when inspecting construction work sites where power-operated equipment is present that is covered by the crane and derrick rule, Subpart CC.  This is the first compliance directive issued regarding application of this rule.  It's dated 10/17/14
  • There are changes coming to the NM Crane Law too! The next NM Hoisting Council is scheduled for October 31, 2014 at the RLD CID building on San Mateo  11-2pm. At the previous meeting the Council introduced and unanimously passed a resolution to change the two ton to ten ton in the hoisting equipment definition, and seat hours from five hundred to fifty hours for Class II operators  to qualify for Class I Operator.  This resolution effectively will create legislation to change the statute in the 2015 NM Legislative Session. Although the agenda has not been released for this week's meeting, we are expecting a proposed new definition of "Crane" since the current definition is quite broad and may include other pieces of construction equipment that our industry uses daily. The meetings are open to the public.
