The annual NUCA Washington Summit is scheduled for May 19-22 in Washington D.C. Love or hate politics it is a necessity in business today and this summit is a very informative and interactive experience that I recommend to all. During the summit, we'll visit NM's Delegation, be brought up-to-speed on legislative issues that affect our industry from regulations to funding, and even do a little celebrating in honor of NUCA's 50th Anniversary. Hoisting Operator's Licensure Examining Council

On March 28, 2014 the NM Hoisting Operator's Licensure Examining Council met and Jane Jernigan, NUCA of NM, was in attendance. I am pleased to share that the new member on the council is John Brown, Bradbury Stamm.
There are several issues of concern with the hoisting law and its subsequent rules and regulations including those that are proposed including the definition of "Hoisting" and "Hoisting Equipment", the definition of "Crane" and the inconsistency of a crane's lifting capacity which is a measurement of whether a piece of equipment is subjected to the current crane law.
The Council passed a motion that legal council will review the current definition of hoisting and hoisting equipment. The Council will also move forward on correcting the lifting capacity of a crane to ensure not only consistency throughout the regulations but to also ensure that certain construction equipment would not be included in the regulations that would not otherwise be considered a crane or hoisting equipment. This last change will require a change in law and will have to be done through legislation.
Other changes will be considered as well but were mostly corrections in the recent House Bill 101 passed in 2013.
The next meeting of the Council is scheduled for August 8, 2014 at 11am at the CID Conference Room. If you would like further information, please contact Jane at the association office.
Local construction associations, including NUCA of NM, will also be meeting prior to August to discuss the above referenced changes and draft language for legislative consideration.

Worker's Compensation Advisory Council

As reported in the previous newsletter, the Worker's Compensation Bills that were rejected in the previous legislative session was a serious blow to our industry given the fact that the language was clearly defined by intent by the worker who caused harm, injury, or death to him or her self and or others. The reason give by those voting against the legislation on the House Labor and Human Resources Committee was that the proposed legislation had not been vetted through the Worker's Compensation Advisory Council (WCAC) and thus there was no recommendation from the WCAC to guide them. Of course, the reason why these proposed pieces of legislation were not vetted through the WCAC was because they have not met in over two years due to a disagreement over an appointed member.
However, with disagreements resolved, the WCAC is meeting during this interim and the proposed legislation will be discussed in a sub-committee of which Jane Jernigan, NUCA of NM Executive Director, is a part of. This will allow input from our industry on our concerns about drug and alcohol use prior and during work, and will also allow us to offer solutions. I'll keep you updated on any progress. See below for the proposed legislation from the 2014 session that did not pass out of committee.

Worker's Compensation Bills
HB 113 WORKERS' COMP PAYMENT FOR INTENT OR DRUG USE
WORKERS' COMP PAYMENT FOR INTENT OR DRUG USE
House Bill 113 (HB 113) bars indemnity or medical benefits otherwise payable under the Workers' Compensation Act (the Act) when a worker's injury or death was "willfully caused by the worker or intentionally inflicted by the worker" or when alcohol or drugs contribute to any degree to injury or death. This bill died as expected in the House Labor Committee where it was opposed by union representatives.
HB 290 WORKERS' COMP BENEFITS & INTOXICATION
House Bill 290 clarifies the provision barring worker's compensation when the injury was willfully self-inflicted by the worker. It also imposes a new standard to be employed as to the existing bar to compensation when an injury to or death of a worker is due solely to the worker's intoxication, which is when test results for intoxication are in excess of the Department of Transportation's cutoff concentrations for intoxicating substances, unless the intoxicating substance had been prescribed or administered to the worker as authorized by a licensed practitioner. This bill also died as expected in the House Labor Committee. DID NOT PASS

NUCA of NM Safety Awards
Applications for the 2013 NUCA of NM Safety Awards are now available. There are four categories which are based on man-hours.
The applications are due by no later than April 30, 2014 and winners will be presented their awards at the Mid-Year-Social event at El Pinto on June 19, 2014 6-9pm.

Applications to participate in the Zia Partnership are now being accepted. Please use the links below to access everything you need to apply and to get more information on the partnership.
There are three levels of participation, so your company can fit in to the program. If you have any questions, please call Jane at the Association office - 505 888 0752. I can also put you in contact with current partnership members if you prefer, or you can attend the next Safety Committee meeting on April 9, 2014 at 8am at the Association office.
Partnerships will be announced at the June 19, 2014 Mid-Year-Social at El Pinto 6pm-9pm. This is a member benefit and there is no cost to participate or apply but you must be a NUCA of NM member.
