Greetings Members!!

Hello Members!
For the November Newsletter, I mailed out a hard copy for you to browse through at your convenience. If you DID NOT receive a hard copy but would like to in the future, please call me so that I can add your name and address to the database.
2013 has been a very busy and successful year for NUCA of NM, but we're nearing the end and getting ready to enter into another year that hopefully will strengthen us through growth and support from members. As you consider renewing your membership, please take a moment to reflect on the successes of this year and know that we could NOT have done it without you! Outside of regular committee meetings, there is only one more opportunity for you to attend a NUCA of NM event before we're looking at 2014! Please join us for the End-of-Year Social on December 5th 6-9pm. An invitation is forthcoming in the mail. This event is less business like and geared more towards being a social event where you can enjoy dinner, drinks and company. We'll have a few minutes of official business as we recognize outgoing and incoming board members, Investment Sponsors, Committee Members, and introduce the leadership for 2014.
Also, the Board of Directors will be conducting their 2014 Planning Session in December and they want to hear from you! Is there something you want to see more of? Do you have an idea that would create a valuable resource for members? Whether your feedback is positive or negative, we need to hear it so that we can improve and sustain a valuable and worthwhile experience for NUCA of NM Members.
Check out the upcoming dates for meetings and events for November as most committees do not meet in December. Your last chance to get trained in the OSHA GHS is coming up this week and the deadline for training is December 1, 2013.

Greetings all,
What a wonderful time of year, my personal favorite with a chill in the air, balloons flying and Holidays just around the corner.
As you all know NUCA is an Organization dedicated specifically to the Underground Utility Contractor, however without the support of our wonderful Associate members we would not be able to survive . A hats off and huge applause for those Associate members who support NUCA!
The last few years of economic downturn have been tough on most of our members and NUCA as well. Our board members have worked hard to come up with cost cutting measures as well as innovative Non-dues generated revenue to insure the financial health of this organization for the future, Thank You board members.
All of our committees have continued to meet on a scheduled basis and have been very productive and come up with great ideas, keep up the good work.
Don't forget that our Executive Director, Jane Jernigan, is your go-to resource for everything NUCA. She is also very involved in our national group and can help you utilize your membership benefits with ease. Don't hesitate to call her if you need information on anything related to the industry.
I look forward to seeing you all at our next association meeting at the end of the year social on December 5th!

Energy Equipment & Infrastructure Alliance Asks For Support As a member of the Energy Equipment and Infrastructure Alliance, NUCA recently signed a letter that urges key lawmakers to reject any proposal to eliminate expensing for intangible drilling costs when considering tax reform.
NUCA Member Advocates Needed Now that the government is reopened, we anticipate that Congress will address important NUCA issues before the end of the year. Sometimes we need members to write personal letters to their Representatives when we know certain bills will be addressed. Safety Director George Kennedy: Pay Attention to New Proposed Rule on Silica Exposure "The new silica standard, if approved as written, could have catastrophic financial consequences for contractors" This is the message George Kennedy wants members to hear. He says it is imperative that members take time to read the compliance section of the new rule*, (up to Appendix A), consider the financial burden this will bring to their companies, and either submit comments to OSHA on behalf of their companies or send their cost estimates to George, so that he will have documentary evidence to include in NUCA's comments and possible testimony. Kennedy believes that OMB's cost estimates for implementation are significantly low and is concerned that the rules will result in a tremendous burden on NUCA contractors. Please contact George Kennedy if you can provide cost estimates or are interested in presenting written testimony.

Federal Contractors Face Hiring Quotas for Veterans and Disabled Workers The Department of Labor issued a pair of rules August 27 that will require most government contractors to adopt a benchmark based on the national percentage of veterans in the workforce (currently 8 percent), or their own benchmark based on the best available data. Labor officials say the new benchmarks are only goals and not specific hiring quotas. But companies must show documentation that they tried to meet the goal or risk having their federal contracts revoked. The rules may be challenged in court. NUCA is keeping a close eye on this and will keep you posted of any updates or changes.

NUCA of NM Welcomes Mayor Berry and Tom Skibitski

The NUCA of NM Membership in October had a packed agenda but it was a very informative lunch for all. Recently re-elected Mayor Berry stopped by to thank NUCA of NM and its members for their support in his recent campaign and he also gave some insight on his upcoming term. Mike Riordan, City of Albuquerque Director of Municipal Development, also spoke to members about the "Drainage Ordinance" being considered for a vote by the City of Alb., Council. The Drainage Ordinance is an unfunded federal mandate but must be passed or the city could face astronomical fines and imposed rules from the Environmental Protection Agency. NUCA of NM voiced concern regarding the ordinance in May 2013. The issues of concern included stringent reductions in how much stormwater flows into waterbodies, cost impacts on projects, & affects on Albuquerque's economic development prospects. Mike Riordan stated that, "After working with the development community for more than a year, the city of Albuquerque is now proposing cost effective solutions for our local climate, helping to reduce pollutants into the Rio Grande River as mandated by the Environmental Protection Agency." Riordan also stated that a lot of the concerns from industry have been addressed and fixed and he expects the City of Albuquerque Council to pass the ordinance on Monday, October 21, 2013.Tom Skitbitski, Chief Department of Energy Oversight Bureau of NM, presented and reviewed the New Mexico Environmental Department Regulation Summary. Clean Water Council Study Gives Proof for Economic Growth
|
The Clean Water Council's (CWC) Sudden Impact Report is an Assessment of Short-Term Economic Impacts of Water and Wastewater Construction Projects in the United States. This resource has been so valuable when talking to our legislators at both the state and federal level. New Mexico's construction industry has been hit hard by the recession and is not bouncing back as quickly or as strongly as our surrounding states. Results and Analysis Of the CWC's study specifically for New Mexico resulted in the following:
- An investment of $1 billion in New Mexico's water and wastewater infrastructure would result in an estimated $1.7 to 2 billion demand for good and services across the state's economy.
- Industries that provide goods and services in support of infrastructure projects would experience almost $390 million in goods and services as households spend money in the economy.
- 15,329 to 20,901 jobs would be created with 6,000 occurring in sectors other than water and wastewater construction and more then 9,000 jobs would be in the pipe construction sector where earnings average $40,930.
Analysis-The CWC analyzed data from 18 completed projects in New Mexico that ranged in size from $120,000 to $9.2 million and covered 10 counties. --A $2.6 million project to install new water and sewer lines in Dona Ana County illustrates the local economic impacts of these investments. Altogether the infrastructure investment resulted in slightly less than $4 million in demand for products and services. In addition to the $2.6 million investment for the water and sewer lines, about $730,000 were spent on supplies and services necessary to complete such work. Re-spending of income resulted in another $610,000 in local economic demand as households paid for goods and services ranging from rent, motor vehicles, gas, etc. More than 40 jobs were created, including an estimated 27 in water pipe construction sector and another 15 across other economic sectors. An estimated $1.3 million in employee compensation derived from the initial $2.6 million investment and state and local tax revenues were affected an estimated $80,000. NUCA of NM continually puts forth effort to increase and sustain infrastructure funding in New Mexico and the United States. One of the main purposes of traveling to Washington D.C. each year is to educate our lawmakers on the needs of the infrastructure industry and the benefits of investing in it. Each year funding is slashed and the gap between needs and available resources widens.
Lifting the cap on Private Activity Bonds (PAB) and encouraging the use of Public Private Partnerships (P3) are two initiatives that NUCA of NM is pushing at both the state and federal level. These two initiatives have the potential to increase funding into our industry going into the future. (Waste Management lifted the cap on PAB's over 10 years ago and has enjoyed increased funding and was the ONLY industry to score higher than a C on the 2013 ASCE Infrastructure Score Card). The P3 legislation passed the NM House last year but ran out of time to cycle through the Senate side; because of this, proponents, including NUCA of NM, have been meeting with and presenting information to legislators to increase the probability of passage in the 2014 Legislative Session.

WRRDA Passes House 10/23/2013
|
The US House approved the NUCA and Clean Water Council endorsed Water Resources Reform and Development Act by a whopping bipartisan margin of 417-3.NM Congressman Pearce, Lujan & Congresswoman Grisham voted for passage of this bill. In May 2013, Jane Jernigan, NUCA of NM Executive Director, and NUCA of NM members visited the NM congregational delegation to discuss and encourage the passage of this legislation. WRRDA is historically the authorizing legislation of water projects studied, planned and developed by the Army Corps of Engineers. Last authorized in 2007, WRDA authorizes projects for flood control, navigation, ecosystem restoration, water supply and emergency management. WRRDA also authorizes the agency to establish grant programs to assist local and state governments with funding. The funding/costs of passage is $5-7 Billion over 2014-2018. NUCA of NM also spoke with NM's Delegation about the Water Infrastructure Finance Innovation Act (WIFIA), Regulations From the Executive in Need of Scrutiny Act (REINS), Private Activity Bonds (PABs) for water and wastewater infrastructure-specifically lifting the state cap, & adequate funding for the EPA's State Revolving Fund (SRF).
