If you watch television or listen to the radio even occasionally, it is unlikely that you can escape the seemingly countless advertisements for attorneys.  One of my least favorites is a commercial in which the lawyer proclaims, with some apparent degree of pride, that he will "keep you out of court."  Have you ever considered what that statement actually means?
 
Based on my experience, the value of your case is dependent on several factors, to include being able to prove liability, your resulting injuries and related losses, and the responsible person's conduct.  However, the single biggest factor for determining the value of your case may very well be your attorney's willingness to file suit and try your case before a jury.  Why is that?
 
By an attorney announcing that he will "keep you out of court," he is essentially broadcasting for everyone to see and hear, including the insurance company, that he has no intention of ever filing suit in relation to your case. 
 
Without the threat of a lawsuit being filed and your case being tried before a jury, who determines the value of your case? 
 
If there is no threat of a lawsuit being filed, why would the insurance company ever offer to pay full value for all of your losses?
 
The answers to both of these questions are simple and obvious.  First, if there is no threat of a lawsuit being filed and your case actually being tried before a jury, the insurance company will decide the value of your case.  In that situation, it is highly unlikely that the insurance company would ever offer to fully compensate you for all of your losses.
 
The lure of a quick settlement may sound appealing, until you consider that this is exactly what the insurance company wants.  It saves them the expense associated with defending the case (to include hiring an attorney and the cost of preparing for trial) and it eliminates the risk of a sizeable jury verdict.  So not only does the insurance company gain by not paying full value on your claim, it also avoids the cost of defending a lawsuit. 
 
In the end, the practice of law is about helping people to resolve their problems.  It is not about outlandish representations or promises of quick cash.  There are enough unscrupulous people and businesses in Alabama that prey on the vulnerable and unsuspecting -- make sure that your attorney is not one of them.
