Team EG&H is Feeding America's "Food from the Bar" Rookie of the Year!

 

This month, our firm rallied together to help end hunger by participating in a countywide competition in which San Diego law firms compete to see who can make the biggest impact to overrule hunger.

 

With help from our attorneys, staff, friends and colleagues we earned the title of Rookie of the Year by raising nearly $2,000 in funds, volunteering over 150 hours and collecting over 300 pounds of food!

 

In all the competition raised over $52,000 and will provide over 415,000 meals to San Diegans in need.

At a board meeting the other evening I was asked by an owner whether the board should have a written investment policy for the association. I noticed some of the board members shaking their heads in disbelief at the question and probably thinking to themselves, yet another thing for us to do. 


The board was not pleased with my answer which I shared privately... Many boards work hard to protect the association's assets. Subsequent boards can undo years of well managed financial planning because no investment road map was left behind by the previous boards.


Having an investment policy allows continuity in managing association funds. An Investment Policy helps protect and preserve the association's assets and a yearly review of the investment policy is necessary to insure its success.

Using Submeters to 
Reduce Water Consumption

Governor Brown's executive order dated April 1, 2015, mandates a 25% statewide reduction in urban water use.  That mandate requires water-saving targets between 12% and 36% for the San Diego County Water Authority's 20 member agencies. The City of San Diego, for example, is under mandatory water use restrictions and must reduce its water usage by a collective 16%. In Riverside, the Western Municipal Water District has a goal of reducing outdoor water use by 30% and recommends reducing outdoor watering by 50%. The Coachella Valley Water District has implemented mandatory water restrictions to reduce water use by 36%. Given this climate, it is hard to imagine that the cost of water will drop any time soon.


It is in everyone's interest to conserve water. Yet, communities that are commonly metered have less incentive to do so. These communities should try to instill an attitude conducive to conservation. One way is to convert to submeters. When the water bill is just a piece of the monthly assessment, residents don't see the connection between their personal water use and their monthly bills as directly as when each home receives its own water bill. However, communities that have converted to submeters have seen a 20% to 25% reduction in water use.

Water Meters - 
Are You Buying Someone Else's Water?

Almost every year since I moved to California in 1985, I have heard of some association that learned it has been paying water bills for water meters that serve other properties, or conversely, that one association learned that a second association has been paying water bills for meters that have been irrigating the property of the first.  

When this occurs, the accusations begin to fly from the current board to prior boards, from the association to its developer, from the association to one or more prior management companies, from the current management company to the prior management company, and so on.

 

The fact is that most association boards and their managers assume that, if they are getting a water bill, it is for water they have used. When the mistake is discovered, many times it is a mistake that has continued undetected for years, and in some cases, for a decade or more. While there is probably some recourse for recovering money that was paid on someone else's behalf, there is probably not much chance for recovering more than the payments made over the last two because of the applicable statutes of limitations. Continue Reading
