Exclusive Use Common Area Maintenance

Did you know the law is changing?
Beginning January 1, 2017, Civil Code section 4775 will provide that the owner of the separate interest (lot or unit) is responsible for maintaining the exclusive use common area and the association is responsible for repairing and replacing the exclusive use common area.

This new change brings up several questions...
  • What is considered exclusive use common area?
  • How does it affect specific components?
  • What is the difference between maintenance, repair and/or replacement?
  • Do CC&Rs need to be amended and if so, how?
Find the answers to these questions and more at CAI San Diego's North County Trade Show and Luncheon on March 4, 2015, at the Sheraton Carlsbad.

Susan M. Hawks McClinitic, Esq., will be speaking with Andy Henley of ProTec Building Services to discuss this new and upcoming hot topic.
