Legislative Update - Pressure Washing, Architectural Guidelines and Low Water-Using Plants
Effective September 18, 2014, a provision of community association governing documents is void and unenforceable if it requires pressure washing the exterior of a separate interest and exclusive use common area during a declared drought emergency. For details, see the NEW Civil Code section 4736.  

The same bill that added section 4736 also changed the Davis-Stirling Act provision on Architectural Guidelines and Low Water-Using Plants...again! See the latest changes to Civil Code section 4735, which are now in effect.

It's that time of year again!  Whether you're working on mandatory annual disclosures or preparing your list of "ask the attorney" questions for this year's Legal Symposium, we know that this time of year is always busy. We've lived with the changes to the Civil Code (a.k.a. Davis-Stirling 2014) for almost a year...and for most of you, it's that time of year again!  Annual Budget Reports. Annual Policy Statements. Other Mandatory Disclosures, and even some Optional Disclosures. This important, detailed and extremely informative checklist of annual disclosures outlines the essentials you need to prepare the appropriate documentation for distribution to community association homeowners.

that Susan M. Hawks McClintic was named co-managing shareholder of the firm effective August 1, 2014. Sue will work hand in hand with senior managing shareholder Jon H. Epsten. Sue has been an attorney at EG&H for 24 years and the head of the firm's transactional department for 6 years. Sue has been involved in all aspects of the firm's operations for many years and is a welcome addition to the management team.
