Patents Versus Trademarks

What is a patent?

"A patent for an invention is the grant of a property right to the inventor, issued by the Patent and Trademark Office. The term of a new patent is 20 years from the date on which the application for the patent was filed in the United States." U.S. Patent grants are effective only with in the United States and its territories and possessions.

Patents:

  • Protect inventions
  • May or may not make it to commerce
  • Length of protection is limited
  • Are only issued at the federal level
  • Application is complex and costly

What is a trademark?

"A trademark is a word, phrase, slogan, design, or symbol that is used to identify and distinguish merchandise from competing products. A trademark extends globally and is protected by international law."

Trademarks:

  • Protect words, names, symbols, or devices on products and services in commerce
  • Many products/services that are trademarked are not patented
  • Length of protection is not limited, if...
  • Also issued at the state level
  • Much less complex and costly application
