Criminal Background Checks and "Ban the Box"

Employers should be cautious when checking the backgrounds of their job applicants, including their history of criminal activity. Here are a few important rules to keep in mind:
- Don't base decisions on the fact of an arrest. But, independent evidence of the conduct leading to the arrest might suffice.
- To deny employment because of a criminal conviction, the crime should be related to the job, and denying employment should be consistent with the needs of the business.
- The EEOC says to consider three factors: the nature of the job; the nature of the crime; and the amount of time that has elapsed since the crime occurred.
- When running a background check through a third-party service, the Fair Credit Reporting Act requires employers and reporting agencies to notify applicants of their rights under the law, obtain advance written consent, provide advance written notice that an adverse action may be taken based on information learned through the background check, and provide written notice of the adverse action once it is taken.
Some state and local jurisdictions have adopted "Ban the Box" laws, which prohibit employers from asking about criminal history on an initial job application. Legislative Committee members John Kuehn and Harry Vasilopoulos participated in a panel discussion about this issue on WNIT's Politically Speaking program. Check out the show at:

Michiana Chapter has not increased membership dues for over 15 years, all the while continuing to take on additional expenses and price increases in order to offer exceptional program-ming opportunities to our members.
We offer various types memberships to fit everyone's needs:
- Professional Member: Professionals with 3+ years of HR experience at the exempt level or certified HR professionals.
- General Member: Professionals engaged in HR at the exempt level, but do not meet the requirements of a Professional Member.
- Associate Member: Professionals in a non-exempt HR position, as well as, those who do not meet any of the foregoing categories, but have a bonafide interest in HR.
- Student Member: Limited only to full-time traditional students who are not currently employed and who do not have professional HR work experience. It's for individuals who are exploring the possibility of a future career in HR.
- Transitional Member: On a one-time basis, we offere a free 12 month membership to HR professionals who are currently unemployed. We are not able to refund membership dues to anyone who becomes unemployed, but are happy to extend this offer to anyone who is unemployed at the time of membership.
Beginning April 1, 2015, membership rates will be pro-rated at the beginning of each quarter:
- April 1st through June 30th by 25% - $60.00 (discounted rate of $30 for National SHRM Members)
- July 1st through September 30th by 50% - $40.00 (discounted rate of $20 for National SHRM Members)
- October 1st through December 31st by 75% - $20.00 (discounted rate of $10 for National SHRM Members)

 It's finally Spring in Michiana! We all deserve a pat on the back for surviving yet another cold, snowy, school-closing-filled winter. Why do we live here? Oh, right-the change of seasons...
Speaking of change, by now I know you've all heard about the change that has taken place with SHRM's new certification where professionals can earn the credentials SHRM-CP and SHRM-SCP. Anyone currently-certified (PHR, SPHR, GPHR, HRBP, HRMP) can take the online tutorial at no charge through December 31, 2015 and earn the additional new certification. Once you complete the process, you will begin a three-year certification cycle and you will not lose or have to give up any of your current credentials. This is a great opportunity to earn the next generation of certification!
The new guidelines have expanded eligibility for certification, so those professionals who may not have qualified for the PHR or SPHR will now find they can attain the new credentials. For more information on the requirements, follow this link to the SHRM Certification web page http://bit.do/2ckY.
You do not have to be a SHRM National member to attain the new certification, but the value of membership far outweighs the cost! As a SHRM member, you gain access to research, sample forms, policies and toolkits, webcasts on topics relevant to HR and professional development and answers to any question you can think of! All of that and more (estimated at a minimum of $2,170) for an annual investment of $190! If you are a first-time member, you are eligible for a discount of $15 if you use the promotional code 0118. And, as a SHRM member, your chapter membership is also discounted!

Plans are underway for a half-day workshop to be held in October and we will be sharing more information about that event in the coming weeks. My phone wasn't working, so I had to call my phone line provider. Two phone technicians came to my house expecting to fix my phone line. They worked for more than an hour until they admitted they had no idea on how to fix the problem. These technicians were maybe twenty-five years old.
I heard one of them say, "Let's call Joe."
"Who's Joe", I asked. "Joe knows everything about phone lines because he's worked here for over thirty-five years, and he's gonna retire this year," said one of the technician's.
My phone line was repaired immediately after Joe described the problem and the solution to both technicians. "We're kinda nervous about our job when Joe retires because we don't know as much as he does," commented both technicians. This happened in 2009.
Where was your lean/quality focus in 2009 during the economic downturn? Did you witness your organization doing little to retain its tribal-knowledge from people like Joe only to end up with a skills gap in 2015?
Where is your lean focus now? It's not enough for you to focus on correction, overproduction, motion, material handling, waiting, inventory, and processing without also addressing the skills gap. To grow market share, production, revenue and income stream in 2015, you will need to stop sabotaging your organization by being fashionably lean and ignoring ways to maximize and capitalize on your workforce, especially people like Joe.
Your inability to fill the skills gap is a missing link in your supply chain; it's a bottleneck choking off your pace for process improvements, defect prevention, reduction of variation and waste. In your supply chain at your company, there is a shortage of skills like Joe. Today, there is more of a demand for you to recognize the need to develop your workforce talent.
