Providers can't sue state Medicaid agencies over rates, Supreme Court rules
Private healthcare providers cannot sue state Medicaid agencies over low reimbursement rates, the U.S. Supreme Court decided Tuesday in a 5-4 decision, reversing a lower court's ruling. Read more.

New Study on Employer Compliance with Mental Health Parity Laws

 

 

The Disability Management Employer Coalition (DMEC) has published a  new report on mental health  in the workplace, based on surveys of human resources and disability professionals of diverse  employers from across the nation. Of the 314 employers who responded to the survey, 87 percent have more than 1,000 employees.

 

DMEC found, for the first time since 2006, that stigma associated with mental health is increasing among employers. The report found that, despite greater reliance on employee assistance programs and personalized aspects of return-to-work processes, around 25 percent of respondents believe that stigma against those receiving mental health treatment or living with behavioral health issues is increasing. Paid to sleep: NY state cracks down on napping health workers
 

By day, Tanya Lemon was a 35-year-old single mother who took care of her four children. By night, she worked 12-hour shifts as a nurse at a state group home in suburban Syracuse, paid to watch over vulnerable residents as they slept.

That's also when she got her own sleep, prosecutors say - a routine that led to felony charges when Dennis Dattalo, a 25-year-old disabled man who couldn't speak, ran low on oxygen while on her watch and later died.

Makers of Generic Drugs Challenge F.D.A. Plan for Updated Warnings

 

The pharmaceutical industry mounted a new challenge on Friday to a federal plan that would require generic drug companies to take the initiative to update their labels to warn consumers whenever health risks were discovered, a shift that would expose the companies to legal liability.

More than 80 percent of prescriptions in the United States are now filled by generic versions of a drug, and most states permit pharmacists to dispense a generic in place of a prescribed brand-name drug.  Read more.
