Is There Insurance Coverage for Losses Stemming from Government Shutdown or Default?

At the time of this writing, the federal government is in a partial shutdown. Essential functions are operating, but certain areas such as national parks are completely closed. While this partial shutdown does not threaten the validity of federal debt, some fear that a similar impasse regarding the debt ceiling could trigger a partial or full federal default. 

  

Understanding Obamacare

As part of the Affordable Care Act individual mandate, U.S. citizens and legal residents will be required to have qualifying health coverage starting in 2014. Those who do not have insurance through their employer or through Medicaid or Medicare will have the option to go to a new marketplace in their state to enroll in a private healthcare plan. Open enrollment in the exchanges will last from Oct. 1, 2013, through March 31, 2014; coverage will begin as early as Jan. 1, 2014.

  

Government Shutdown - Now What?

The failure of Congress to agree on a new budget for the Fiscal Year (beginning October 1) is resulting in a furlough of more than 800,000 federal workers and government agencies temporarily closing or cutting back the operations of numerous federal facilities and the suspension of many services. This is the first government shutdown in 17 years.

  

D&O - Scope of Contractual Liability Exclusion - Alabama Federal Court Rules in Favor of Insurer

The U.S. District Court for the Middle District of Alabama recently upheld a contractual liability exclusion in a private company D&O policy issued to a non-governmental agency in the City of Montgomery. Landmark Amer. Ins. Co. v. The Industrial Development Bd. of the City of Montgomery, No. 13-cv-230, (M.D. Ala., Decided September 9, 2013).
