Professional Liability Defense Federation is holding their 4th Annual Meeting and CLE Presentation in Chicago at the Westin Michigan Avenue.  The dates are October 9-11, 2013. It is a fantastic time to meet with other Professional Liability lawyers from all over the country in a more intimate setting where relationship building is more easily accomplished.  We have an excellent program with discussions and developments in legal, medical, construction design, real estate agent/broker, accountant, and miscellaneous professional liability claims.  Information will be shared on trial tactics such as preparing arrogant and other challenging clients for trial and methods to perform social media and avoid UCPA investigations in the course of adjustment and defense of Professional Liability Claims.  Registration is available on the PLDF website at www.pldf.org.  All are welcome.

If Your Files Could Talk, What Would They Say?

It is extremely important for all agency staff to realize that when an E&O claim is made against their agency, they will be asked to provide a complete copy of the specific file that the claim pertains to. The file may consist of paper or be an electronic one or a combination of the two. 

Fewer Than 90 Days and Counting . . . Are You Ready for the HIPAA Compliance Deadline?

Covered entities and business associates have fewer than 90 days, or until September 23, 2013, to come into full compliance with the HIPAA Omnibus Final Rule (the "HIPAA Final Rule"). The HIPAA Final Rule details several new requirements for covered entities and business associates and requires changes in policies and procedures of covered entities and business associates.

Hey California Self-Insurers, don't forget about SB 863

The Problem:

 

On September 18, 2012, California Governor Jerry Brown signed SB 863 into law, making many changes to California's workers' compensation system. This bill prevents "professional employer organizations," temporary agencies, and employee leasing organizations from being self-insured, as well as stopping an employer who has been illegally uninsured from becoming self-insured unless the employer receives approval from the Self-Insurers' Security Fund (SISF) via approval from The Office of Self Insurance Plans (OSIP).
