Government Affairs Update
 In the U.S. on Friday February 8th, a federal appeals court threw out an Energy Department rule that could have forced decorative fireplaces to meet federal energy efficiency standards. A divided panel of the U.S. Court of Appeals for the District of Columbia said the Energy Department rule made no sense, since the appliances are purchased for their appearance rather than to heat homes or businesses.
HPBA, supported by Canadian members and staff, have fought long and hard for this ruling. While this is not the end of the matter, it is nevertheless a highly positive development. HPBA and HPBA Canada do not object to efficiency standards for appliances that are designed to be heaters but they cannot accept the principle that such standards should be applied to decorative models. Had the ruling gone against HPBA, there could have been severe repercussions for the industry on both sides of the border. In fact HPBA Canada is currently in discussions with Natural Resources Canada regarding these very same issues. If decorative gas fireplaces were to be subjected to minimum efficiencies, much of the product our members manufacture and sell would likely disappear. This is a great example of what can be achieved when members of the industry come together through their industry association.
