Anti-SPAM Legislation: Does It Affect Your Business?
After six years of debate and deliberation, the Canadian Radio-television and Telecommunications Commission (CRTC) has introduced a bill legislating SPAM, which will be brought into law by the Federal Government July 1, 2014. Scott Smith, the Director of Intellectual Property and Innovation Policy for the Canadian Chamber of Commerce, states that the new law is very broad in defining SPAM and has "criminalized" something that we historically know to be an "inconvenience". Any unsolicited Commercial Electronic Message (CEM), whether it be e-mail or text message, can result in legal action against the sender. The recipient may sue the sender and the CRTC can level penalties as high as $1,000,000 for individuals or $10,000,000 for businesses. In order to send any CEM, (intended to sell an item/service) to an individual/business the sender must have the "opt-in" permission of the recipient; meaning the sender must have the explicit permission of the recipient to send CEM's to the recipient. This consent must be collected via standard mail, on a website, or in-person. It is not valid to receive permission via e-mail or text. Further, all correspondence must have an unsubscribe mechanism built into it. The onus will be on the sender to maintain a record of these permissions. The only exceptions to this new law are charities and politicians.
