Post-Operative Death of Green Energy Pioneer Spurs Law Suit
Partner Nancy La Vista filed a lawsuit against the University of Miami d/b/a University of Miami Hospital and its medical resident for the wrongful death of green energy pioneer and highly regarded researcher Subrato Chandra. The suit alleges hospital staff failed to respond appropriately to Chandra's post-operative complications, which led to cardiac arrest and fatal oxygen deprivation to his brain. On behalf of her client, Nancy alleged that the University of Miami Hospital and the resident on duty were negligent in providing medical and surgical services within the standard of care and that the hospital was negligent in failing to properly credential its resident.
Firm Upholds National Reputation with Complex
Product Liability Case

A young electrician was crushed to death while operating a motorized aerial work platform, known as a scissor lift. The decedent left behind a young daughter. Based on Clark Fountain's national reputation for litigating catastrophic injury in wrongful death cases, Mark Clark and Tim Murphy were selected to represent the Estate. The team pursued a products liability suit against nine corporate defendants responsible for the electrical and mechanical systems on the scissor lift over three years, conducting discovery throughout the United States and Canada. Experts were brought in from around the United States and represented a veritable "who's who" in electrical engineering. Facing potential punitive damages and exposure, the defendants ultimately agreed to pay a confidential settlement.

Distracted Driving 2.0

At the January 2013 Consumer Electronics Show in Las Vegas, a preview of what the future holds was on display, and some news outlets predicted more distracted driving, as technology merged smartphone functions with newer model vehicles. FOX News reported that while the advancements are designed to make driving safer, the integration of talking, texting, emails, music and more into the car's dashboard and steering wheel may make vehicular rule-making even more difficult for the National Highway Traffic Safety Administration - not to mention challenging the focus of the driver. Subaru Recalls Legacy, Outback and Tribeca Models for Fire Hazard
Subaru is recalling about 54,000 2010 and 2011 Legacy and Outback vehicles, certain model year 2006 through 2012 Tribeca vehicles, and certain model year 2009 through 2012 Forester vehicles. These vehicles may have been equipped with accessory puddle lights that, when illuminated, brighten the area under the doors of the vehicle. A short circuit can develop when either the puddle light or connector is exposed to an electrolytic moisture source (such as road spray that has road salt in it), and it penetrates the circuit board of the puddle light or the pins of the puddle light connector(s). Over time, migration of the moisture into the circuit board and/or into the connector cavity may result in a short circuit of the puddle light system. This may generate heat which may melt the plastic resulting in smoke or fire. Read more here.
General Motors Recalls 54,000+ Vehicles With Parking Malfunction
General Motors (GM) is recalling more than 54,600 Cadillac Escalade, Escalade ESV, and Escalade EXT; Chevrolet Avalanche, Express, Silverado HD, Silverado LD, Suburban, and Tahoe; and GMC Savana, Sierra HD, Sierra LD, Yukon, and Yukon XL vehicles. The vehicles may have been built with a fractured park lock cable or a malformed steering column lock actuator gear in the lock module assembly. As a result, the vehicle may shift from Park with the ignition key removed or the ignition key in the OFF position. The vehicle may also shift out of Park without application of the brake pedal while the key is off. These scenarios may cause the vehicle to roll away after the driver has exited the vehicle, resulting in a possible vehicle crash and/or injury. Learn more here.
Sassy and Carter's-branded Baby Toys Recalled Due to Choking Hazard
Approximately 45,300 Sassy®-branded Hug N' Tug Puppy and Monkey and Carter's®-branded Hug N' Tug Monkey Toys have been recalled because the beads inside the clear plastic sphere at the center of the toys can be released and pose a choking hazard to young children. The company has received 12 reports of beads being released from the clear plastic sphere body on Sassy-branded toys that were sold at mass merchandisers and online in 2011 and 2012. Learn more here.
