When Did Government Lose Its Sanity?

Writing a weekly newsletter and producing On Target Radio keeps me scouring for news constantly. I get news feeds from all over the world and more than I can remember from here in the U.S. I read the papers over morning coffee then sit at the computer, sometimes for over an hour, reading online feeds. The one thing that jumps out at me every single day is this country is going to hell in a hand basket.

 

Government at all levels has lost touch with reality. It no longer serves the people but rather dictates the whimsy of whatever left-wing, knee-jerk-reacting civil servant decides to flex their muscle instead of their brain. Not a day goes by that some bureaucratic nutcase doesn't draw an arbitrary line in the sand, putting government on the wrong side of reason and compassion. I'll cite just four recent examples, all of which are over the top.

 

In Garland County, Arkansas, the Stanley Family had their seven homeschooled children forcibly taken from their home. The couple was originally informed the children would be returned in 72 hours; that was five weeks ago-still no kids, and no charges have been filed. Last week the Stanleys learned that a hearing scheduled over the matter has been postponed until March 23. Let's be very clear here: the Stanleys could be Mr. and Mrs. Jack T. Ripper for all I know, but that's not the point. The issue is the Garland County government took their children and apparently didn't think it was necessary to mention why.

 

In Washington State a judge ruled that a 70-year-old florist who declined to make flower arrangements for a gay couple's wedding violated the state's anti-discrimination and consumer protection laws. Barronelle Stutzman, the flower shop's owner, said the decision-and its accompanying fines-will put her flower shop out of business or worse. "After the fines and legal fees, there won't be anything left. They want my home. They want my business. They want my personal finances as an example for other people to be quiet," Stutzman said.

 

According to the Washington State Attorney General, no court has ever held that religiously-motivated conduct, expressive or otherwise, trumps state discrimination law in public accommodations. "Religious motivation does not excuse compliance with the law," he said. Apparently he's not talked to the White House about Sharia law lately.

 

Then there's the retired New Jersey teacher facing 10 years in prison and the loss of his state pension for possessing a flintlock pistol that may not have been fired since George Washington was alive. Gordon Van Gilder, a retired English teacher and collector of historical items, has been charged with criminal possession of a handgun and faces up to 10 years in prison. If the 72-year-old is convicted, the charge carries a mandatory minimum sentence of 3.5 years, and the pension Van Gilder earned as an educator could be revoked. "It's crazy," his attorney said. "The gun was unloaded and strictly possessed as a historical relic.

 

The single shot Queen Anne flintlock requires untwisting the barrel to load it, but that's what you get with 1760s technology. "Apparently there must be a lot of drive-by flintlock shootings in North Jersey," Van Gilder quipped.

 

And finally, what's the best way to kick off a White House summit on "Countering Violent Extremism"? If you're this president, it's to invite Islam to preside over the event by opening it with Muslim prayer from an imam and making no mention of any other religion other than one disturbing note from Biden, blaming Christians for a myriad of violent murders.

 

Imam Sheikh Sa'ad Musse Roble, president of the World Peace Organization in Minneapolis, Minnesota, graced the group with a choice verse from the Quran. It was, "Whoever kills a soul unless for a soul or for corruption in the land, it's as if he has slain mankind entirely, and whoever saves one life, it's as if he has saved mankind entirely," which is basically saying kill all nonbelievers. When the heck did we lose control of our own government?

U.S. District Court Finds Provision of

1968 Gun Control Act Unconstitutional

 

In another victory for Second Amendment civil rights by attorney Alan Gura, a United States District Court found a provision of the Gun Control Act of 1968 unconstitutional as applied to some people who, like the plaintiff in the case, are currently law-abiding and not felons, not adjudicated mentally defective and do not have a violent criminal history. In the decision released today, Middle District of Pennsylvania Judge William W. Caldwell ultimately held that "Plaintiff Julio Suarez has established that his background and circumstances place him outside of the intended scope of the law and therefore its application violates Plaintiff's Second Amendment protections."

 

In 1990, Suarez was convicted in Montgomery County, Maryland, of carrying a handgun without a license. The offense was a misdemeanor and subject to a term of imprisonment for not less than 30 days nor more than three years. Following the conviction the record showed Suarez was sentenced to 180 days imprisonment and a $500 fine-both suspended-and he was sentenced to one year probation. Suarez's conviction, according to Defendants Eric Holder and others, places him within the scope of the Gun Control Act of 1968, which bars individuals convicted of certain offenses from possessing a firearm.

 

However the Court held that "Plaintiff's background and circumstances in the years following his conviction establish that he is no more dangerous than a typical law-abiding citizen and poses no continuing threat to society. Therefore, we find that Plaintiff falls outside the intended scope of the law and is distinguishable from those historically barred from Second Amendment protections."

 

BATFE Pushes to Ban AR-15 Ammo

 

BATFE has proposed new regulations banning common AR-15 ammunition, arguing it's necessary to protect the safety of law enforcement officers. The proposal will allow Attorney General Eric Holder to determine if the ammunition in question qualifies under the broad definition of "sporting purposes." Current law gives ATF unfettered justification or power to decide what is and what is not "sporting" and therefore regulated or banned.

 

Over the years, pro-gun-control, big city police chiefs have argued that "assault weapons" are the main firearm being faced by law enforcement officers every day. That just isn't true. In fact when Baltimore County Police Chief James Johnson testified in front of the Senate Judiciary Committee back in 2013, he grossly misled the country when he said his officers were regularly facing this type of firepower in the streets.

 

After the hearing Johnson told reporters, "Police officers face these weapons either in seizure cases or crimes of violence every day. Dozens of police officers have lost their lives due to an assault weapon and a criminal adversary."

 

According to a Baltimore County Police Department report obtained and requested by Townhall, Johnson misled the public with his statement about assault weapons seizures. Between October 1, 2012, and January 30, 2013, the day of Johnson's testimony, Baltimore County Police Officers seized approximately 600 guns, of which only 26 were assault weapons under the Clinton-era definition; they included AR-15s, a few AKs/SKSs and a TEC-22. Less than 5 percent of guns seized in Baltimore County are assault weapons, despite Chief Johnson's statement to the press and implied statements before Congress. ATF is accepting comments about this proposal through March 16.

California AG Asks for Judgment

in Microstamping Suit

 

The California Attorney General this week moved for judgment on the pleadings (effectively, a motion to dismiss) in the NSSF and Sporting Arms and Ammunition Manufacturers' Institute (SAAMI) lawsuit filed early last year challenging a provision of the California Unsafe Handgun Act requiring all semiautomatic handguns not currently registered with the state to be equipped to imprint microstamps on two or more places on the interior surface of the firearm that will transfer to fired ammunition. NSSF challenged this provision of California law because it is impossible for manufacturers to comply with this requirement, thus effectively banning sales of new pistols in California. This motion is set for hearing next month in Fresno Superior Court, and NSSF will vigorously defend the merits of this important case.

 

The law is a back-door attempt to mandate unproven, unreliable and flawed technology in order to prevent the sale of new semiautomatic handguns to law-abiding citizens in California and will not contribute to improving public safety. As with its prior pleadings, the state attempts to misdirect attention by fixating on issues not even raised by NSSF and SAAMI's complaint. 

Senator: Americans Are Arming

Against the Government

 

United States Senator Chris Murphy (D-CT) has introduced a pair of bills in Congress that would impose a five-year prison term for acquiring an 11-round magazine. S.407/H.R. 752, the "Large Capacity Ammunition Feeding Device Act of 2015," introduced by Senator Robert Menendez (D-NJ) and Representative Elizabeth Etsy (D-CT) respectively, would even ban the practice of attaching two of the "acceptable" capacity magazines together getting the perpetrator up to five years in prison.

 

Murphy attempted to justify such a ban with an Army veteran's alleged plot to attack Congress with a rifle. Murphy touted the bill, which would ban magazines of more than 10 rounds, hours after reports circulated that police had foiled a mass shooting plot aimed at Congress. Murphy, it seems, would imprison us for having 11-round magazines because he personally sees such magazines as a threat to his hide. The alleged plot apparently had Murphy thinking quite a lot about the danger to him and his cronies posed by a well-armed citizenry, prompting him to make this remarkable claim: "... those who wanted high-capacity magazines were more interested in 'arming against the government.'"
