Fifth Circuit - No Handgun Under 21

The U.S. Court of Appeals, Fifth Circuit has weighed in on NRA, Payne, Jennings & Harmon v. BATFE, Jones and Holder and it isn't good. The appeal concerns the constitutionality of 18 U.S.C. �� 922(b)(1) and (c)(1), and attendant regulations, which prohibit federally licensed firearms dealers from selling handguns to persons under the age of 21.

 

The appellants, the National Rifle Association and individuals who at the time of filing were over the age of 18 but under the age of 21, brought suit in district court against several federal government agencies challenging the constitutionality of the laws. The essence of their challenge is that the laws violate the Second Amendment and the equal protection component of the Fifth Amendment by preventing law-abiding 18-to-20-year-old adults from purchasing handguns from federally licensed dealers.

 

The NRA argued young adults living more than 220 years ago had a right to purchase firearms but that, and other points, did little to dissuade the court. In a 3-0 ruling, the court held that the age restriction, which dates back to 1968, was "consistent with a longstanding tradition of targeting select groups' ability to access and to use arms for the sake of public safety."

 

Judge Edward Prado, who authored the 41 page opinion, wrote, "Of all gun homicides where an offender was identified, 24 percent were committed by 18 to 20 year olds. This is consistent with the historical pattern of gun homicides over the past ten years." Well duh...

 

It is a statement that belies the gang reality of Houston, where the court, and presumably Prado, resides. Prado seems to have mistaken the clean cut Texan kids with cowboy hats for gang bangers who are inked and haven't figured out which way the bill of a baseball cap is supposed to point. But it is precisely that group of 18 to 20 year olds who are wreaking havoc in Houston, Chicago and everywhere else in major urban areas around the country.

 

Personally, it makes my blood boil. On my 20th birthday I was allowed to have my own firearm. It came with a full auto feature, several magazines of ammo and a box of C rations. In 1967 I celebrated my 20th birthday in a rubber plantation on top of a hill in Vietnam wearing Army green. I joined and asked to be there; a decision I have never regretted, but there are two things I remember for sure: No one suggested I wasn't mature enough to have a weapon and I can't remember anyone in our company shooting anyone else in our company. A couple of punches here and there but no gun play.

 

I understand there has to be some cut-off point; I can't wrap my brain around the idea of a five year old running around with a loaded M-16 but here's a thought: If you're old enough to die in combat for your country, you damn sure ought to be old enough to protect yourself from dying at the hands of some punk driving by in a beater and flashing gang signs. Oh yeah, one other thing, you ought to be old enough to go have a beer before going back to some backward, third world country and fight people mired down in the stone age.

An Open Letter to Hunters and Sportsmen Regarding Barack Obama

 

In a recent open letter to the Illinois' shooting community, Richard Pearson, ISRA-FEDPac Chairman, warned of the potentially severe effect a lame duck President Barak Obama would have on the Second Amendment. "After issuing my open letter to firearm owners four years ago, I received a lot of emails, letters and calls from hunters and outdoorsmen who told me I was wrong about Obama.

They claimed that Obama truly understood the constitution and that the breaking of his ties with the Chicago establishment would move him towards a more gun-friendly state of mind. Now, four years later, I'm afraid I must say, "I told you so." Obama has repaid the gun

owners who supported him with the appointments of two anti-gun, anti-freedom justices to the Supreme Court. And, earlier this week, we heard Obama promise millions of debate-watchers that he would work to reinstate Bill Clinton's ban on semiautomatic rifles, pistols and shotguns. Obama went even a step further by hinting that he was contemplating actions to ban handguns as well."

Cook County Violence Tax First Passes,

Then Takes The Buck

 

Gang bangers shoot one another without reservation and Cook County (Illinois) Board President Toni Preckwinkle passes the buck to John Q. Citizen... Oh yes, then takes it back in the form of greenbacks. Preckwinkle wants a $25 tax on every firearm purchased and a nickel-per-bullet tax on ammunition purchases within the county. You remember those 550 bulk pack .22 caliber cartridges you buy for about $23? Preckwinkle is about to more than double the cost. She justifies her "violence tax" to offset the Cook County criminal justice and public health budgets that are astronomical because of the violence taking place in Cook County. Oh yeah, that and the FY 2013 $115 million projected budget gap. To be fair, others are getting the shaft too - for instance cigarette smokers, whom, rumor has it, she proposes will only be allowed to smoke inside the Republican Party headquarters, are going to get hit with a tax increase too. Gun stores in Cook County are worried and rightfully so. Undoubtedly some will go out of business as the tax drives many buyers to the collar counties where they understand the concept of serving the public and keeping businesses healthy. Elections have consequences people. Let's see if you can make better choices in the upcoming one. Meanwhile, give the commissioners a call and remind them that elections have consequences.

Shooter's Drive to Silence FRC

Leads to Terrorism Indictment

 

Occasionally the system works in the other direction. Take Floyd Lee Corkins II for instance. The United States Attorney's Office announced a federal grand jury has returned a "superseding indictment" against Corkins charging him with several offenses including a District of Columbia charge of committing an act of terrorism. It stems from the August 15, 2012 shooting at the Family Research Council's headquarters. Corkins, who had been a volunteer at a local gay activist organization, invaded the lobby armed with a 9mm pistol, approximately 50 rounds of ammunition, and 15 Chick-fil-A sandwiches purchased the day before; I'm not sure I want to know what he planned to do with the sandwiches. Leo Johnson, FRC's building manager, confronted the gunman, at which time Corkins began firing. Despite being shot, Johnson was able to subdue the shooter, and according to investigators, saved many lives. FRC president Tony Perkins commented, "The terrorism indictment - the first under the District's ten-year-old anti-terrorism statute - makes clear that acts of violence designed to intimidate and silence those who support natural marriage and traditional morality violate the law and undermine the security and stability of our form of government."

Glock Donates $400,000 to National Law Enforcement Officers Memorial Fund

 

Glock has presented a $400,000 donation to the National Law Enforcement Officers Memorial Fund (NLEOMF) in support of the development of the National Law Enforcement Museum. Last year, Glock committed to giving NLEOMF a total of $2 million over five years; this is Glock's second installment of that plan. The donation was made at the National Law Enforcement Museum site in Washington, D.C. "The National Law Enforcement Museum will honor the more than 900,000 sworn law enforcement officers serving our country, and also memorialize the many officers that have given their life in the line of duty. Glock is honored to give to this cause and support the law enforcement community that gives so much to protect our safety," said Glock vice president, Josh Dorsey. The state-of-the-art institution will be located in the Judiciary Square neighborhood, adjacent to the existing National Law Enforcement Officers Memorial. Building and exhibit designs are being finalized, while precious artifacts that reflect the work of law enforcement, past and present, are being collected. Scheduled to open in 2015, the National Law Enforcement Museum will be the world's most comprehensive museum focusing on law enforcement.
