2016 General Session Summary

MADA is pleased to report the 2016 legislative session of the Maryland General Assembly was another successful 90 days.  MADA prides itself on accomplishing our legislative goals in one year as opposed to most pieces of legislation that take multiple years to become law.  During the Fall of 2016, MADA decided to focus on two main law changes: 1) Customer disclosure of all safety related information made available by a manufacturer and 2) allowing trade-in credit for all lease vehicles being traded.  MADA ushered both of these bills past the Maryland Senate and House before midnight on April 11, 2016.  They now await the Governor's signature to become law on October 1, 2016.  

The disclosure of technical service bulletins [TSB] was presented to the legislature in 2015 with and the legislature showing intent to revisit the issue in 2016.  MADA introduced legislation permitted a dealer to disclose recall and TSB information to customers without adverse action by the manufacturer.  Prior to drafting the original legislation, Volkswagen and Honda initiated major recalls and stop sales on vehicles that placed a financial burden on dealers.  In response to these national stop sale directives, MADA amended the original disclosure bill to require manufacturer compensation to a dealer in the amount of 1% of vehicle inventory subject to a stop sale. Or, in the alternative, the manufacturer must compensate a dealer the same as any nationally established compensation program.    This amended bill drew heavy lobbying opposition from the manufacturers. The lobbying corps for the manufacturers has tripled in the last two years.  Despite this opposition, MADA was successful in passing this important disclosure and compensation law.  Maryland and Virginia are the only states with 1% compensation as a minimum floor for any stop sale directive.  MADA thanks Delegate Pam Beidle and Senator Wayne Norman for their sponsorship of this bill.  MADA will be honoring them in the interim.

Delegate Beidle also introduced legislation to enable the application of trade-in tax credit to apply to all vehicles regardless of prior lease or not.  This law will eliminate any confusion about the applicability of tax credit and/or require a lease vehicle to be bought out before getting the tax credit.  Starting October 1, 2016 all trade-in vehicles are eligible for tax credit.

Other noteworthy bills are below:

  1. Mandatory Paid Sick Leave - This legislation imposed very strict sick leave pay requirements on employers.  This bill was defeated in the Senate by the pro-business lobbyists in Annapolis.
  2. Mandatory OEM Parts - The auto body association introduced legislation to require OEM parts for the first two years of vehicle life.  This bill was lobbied hard in opposition by the insurers and ultimately failed.  MADA is going to consider making this bill a priority in future years.
  3. Bank Funding of Vehicle Contracts - MADA introduced legislation to require banks to fund dealers two days after approval of a retail installment contract.   This bill was introduced to start conversation with the banks about a better process to fund dealers.  The bankers have committed to working on a more streamlined process in the interim.

To all members of MADA:

Today, April 20th, is officially my last day with the Association and it's one marked by excitement and sadness as I leave behind this second home.  It's hard to believe, but I've been here for over 8 1/2 years!  My husband, baby daughter, and I are moving to Richmond next week in order for him to be more centrally located in his territory which is all of MD, DC, and VA.  While I look forward to the next chapter in our lives, I am sad to leave MADA and the wonderful people with whom I've had the pleasure to work with over the years.

Working at the Association and learning all about the dealership industry has been my honor; what you all do on a day to day basis astounds me and please know that you've got an ambassador for the franchised dealer system in me.  I thank all of you for your friendship and support over the years.  I wish you all the best and that your relative businesses continue to thrive in the years to come.

MADA Sponsors Students In National Technical Competition
For the fifth year in a row, MADA has sponsored two students from Parkside High School in Salisbury, MD to compete in the National Automotive Technology Competition.  The annual competition is held during the New York International Auto Show in New York City.  This year's students, Cory Lewis and Eddie Merritt, competed  against 29 other teams from around the country and Canada.   

Many thanks to Gateway Subaru in Delmar, MD who helped the students prepare in the weeks leading up to the competition.  They opened their service department and assisted the students and their instructor, Dave White, as they learned all about the Subaru on which they would compete.

Correction to Last Issue of OTM
In the April 7, 2016 issue of On the Move, we misspelled the company name of PDP Group, Inc.  Both Chuck Verschoore and Jason Schoppert work for PDP Group, Inc, not PDF Group, Inc.  The other individual shown in the photograph with Chuck and Jason was MADA employee, Al Scrimger, not Al Scimger.
