Loaner Car Update
As customers return to your dealership to address open recalls on their automobiles, you may find the need to increase your loaner car fleet for service replacements.  MADA wants to remind dealers that state law permits any vehicle used strictly as a "replacement vehicle" to be exempt from excise tax until the vehicle is ultimately sold.  The Transportation Article defines replacement vehicle as: "a vehicle that is loaned by an automobile repair facility or a dealer, or that an individual rents temporarily to use while a vehicle owned by the individual is not in use because of a loss, as 'loss' is defined in that individual's applicable private passenger automobile insurance policy, or because of breakdown, repair, service or damage."  Therefore, if the need for more replacement loaners is required to meet recall demand, it's possible for dealers to register these vehicles without paying excise tax upfront.  Please note, if any dealer decides to charge a daily rental rate for the use of a replacement vehicle, they must charge the daily rental rate and remit the excise tax to the Comptroller's office.
EEOC Report Due by September 30 for Dealers With 100 or More Employees
Equal Employment Opportunity Commission (EEOC) reports (form EEO -1) are required to be submitted by employers who have 100 or more employees, and employers who employ a total of 100 or more employees from "affiliated entities." The report must be generated from data collected during any pay period between July and September 2015. The data must include all full-time and part-time employees. These reports are due to the EEOC no later than September 30, 2015.

Affiliated Entities
Entities are considered "affiliated" if they have centralized ownership, control or management. Even if each location or business operation is a separate corporation or business for tax and other purposes, they will still be considered affiliated entities if there is common ownership or control. Multi-establishment employers must file the following multiple reports:
  1. A report for the principal or headquarters office;
  2. A report for each individual location which employs more than 50 persons;
  3. A consolidated report covering all locations and entities, including those with fewer than 50 employees; and
  4. A list showing the name, address, total number of employees, and the major activity for each location (i.e., the type of product manufactured or sold or the type of service provided. This information must accompany the consolidated report.)
Purpose of the Report
The information gathered in this report is primarily used for statistical purposes to measure the hiring practices of women and minorities, and eliminate employment discrimination based on race, color, religion, sex or national origin in private industry. The information is also used in investigating employment discrimination allegations and the enforcement of federal anti-discrimination laws.

Penalties for Non-Compliance
In the event of a complaint of discrimination or harassment, either the EEOC or a local agency considering the complaint will review the reports to aid in a determination of the validity of the complaint.

September is Child Safety Month
Dealers are encouraged to participate in National Child Safety Month this September. Through a partnership between the National Automobile Dealers Association (NADA) and the National Highway Traffic Safety Administration (NHTSA), Child Passenger Safety Month is a nationwide effort to educate parents about the importance of properly securing children in approved car seats, booster seats, or with seat belts when traveling.  

Experts estimate that four out of five child safety seats are installed incorrectly, and that approximately 40 percent of children under the age of eight injured in car crashes are completely unbelted. Oftentimes, these injuries are fatal.

NADA offers free handouts for distribution at inspection events. Information to help dealers plan and host a child safety seat inspection event is available on NADA's web site.  Please visit the MD Kids in Safety Seats website to find other local events that are planned in Maryland.
