2015 Legislative Report

The 2015 Maryland General Assembly has begun its rapid and chaotic finish towards Sine Die.  Most legislators waited until the bill deadline day to file legislation so the days are long for legislators as public bill hearings continue well into the evening.  MADA lobbyists are aggressively pushing legislation that would provide clear authorization for spot delivery transactions.  Public bill hearings have been held in the House of Delegates and Senate.  The main opposition comes from consumer groups that fail to recognize that the vehicle buying process has changed dramatically in the last 30 years.  The Attorney General's office testified that they received 200 complaints on Spot Delivery from 2010 to 2014.  During that same span, the MVA reports that around 4,750,000 new and used vehicles were sold.  Therefore, the AG's complaints represent .004% of cars sold.  These facts prove spot delivery is an accepted practice in Maryland that works to the benefit of consumers and dealers.  Despite these numbers, the consumer groups are actively telling legislators that dealers use spot delivery to bait and switch customers as a common business practice.  MADA is advocating for protections that will enable dealers and customers to understand all rights in a spot delivery transaction.

MADA issued a dealer alert asking for dealers and sales managers to contact legislators regarding this important legislation.  If you have not done so, please go to www.mdauto.org immediately and click on the "Contact Your Legislator" link in the top right hand corner.
