ACA Update:  
Forms Related to New Reporting Requirements, Increased Threshold for Affordable Coverage, and Court Rulings on Subsidies

July was a busy month for news regarding the Affordable Care Act (ACA).  The IRS released drafts of forms related to the new employer reporting requirements for 2015, the IRS raised the threshold for "affordable coverage" under the employer mandate, and the courts issued conflicting rulings on ACA subsidies.

How Employers Should Handle MLR Rebates
 
For the third year, employers who sponsor an insured group health plan may be receiving a Medical Loss Ratio (MLR) rebate from their insurers. Self-funded medical benefit plans are not subject to these requirements. The rebates raise several fundamental questions for employers.

Final Rules - 90 Day Waiting Period & Orientation Period
 
Final regulations were released by the DOL, HHS, and the IRS regarding the Affordable Care Act 90-day waiting period rules, including the new one month "orientation period," which may be imposed prior to the start of the waiting period.

Large Employers Driving HSA Growth

Enrollees use accounts for current needs and to save for future expenses


Nearly 17.4 million Americans are now covered by health savings account/high-deductible health plans (HSA/HDHPs), according to a July 2014 report from AHIP.  Enrollment in HSA plans has grown on average 15% annually since 2011.

EEOC Issues New Enforcement Guidance on Pregnancy Discrimination

On July 14, 2014, the Equal Employment Opportunity Commission (EEOC) issued new Enforcement Guidance (the "Guidance") on pregnancy discrimination and related issues. This is the first update to the EEOC's pregnancy-related Enforcement Guidance in 30 years.

Embezzlement Schemes Often Involve Multiple Parties and Employees   

Embezzlement is often labeled a white-collar crime because of the nature of the criminal-a person of respectable status-and the environment in which the crime occurs-a professional setting. It depends on statutory enactment in each state.

16 States Face High Risk of Earthquakes

Sixteen states are at high risk of damaging earthquakes over the next 50 years and certain areas of the United States face a higher threat of temblors than previously thought, a federal geological survey agency said.

The findings come from updated earthquake hazard maps that were released by the U.S. Geological Survey. The maps are used to help define safe building codes, help emergency responders plan after a quake, and influence insurance rates, the report said.

Relief from Internal Revenue Code Penalties for
Late Filing of Form 5500
December 1, 2014, Deadline for Some Filings

There are additional steps that plan administrators must take, in order to avoid penalties under the Internal Revenue Code, if they failed to timely file the Form 5500 series of annual reports.

A separate filing of Form 8955-SSA is required, even for plan years before 2009.
Plan administrators who fail to timely file the Form 5500 series annual reports can be subject to penalties under both ERISA and the Internal Revenue Code.
