Your Wealth Matters - Did you know...?
The IRS can impose a 50% tax penalty on missed Required Minimum Distributions (RMD) from IRAs. It's true and often times it impacts those who can least afford the cost, the elderly! Owners of IRAs and participants in employer sponsored qualified retirement plans are required to determine and take the required minimum distribution from these tax-deferred retirement savings plans beginning in the year the owner turns age 70 ½ and for each year going forward. One's failure to make a "timely" distribution can lead to a fifty percent tax penalty on the amount that was not distributed.
You can avoid this outcome by taking a few steps now to insure it won't happen to you. First, where possible, combine your IRAs so as to avoid the prospect of missing a distribution. You DO NOT have to take a distribution from every IRA you own, PROVIDED you have correctly determined the total amount that must be distributed from the combination of all your IRAs and/or qualified retirement accounts and made the distribution in a timely manner, by April 15th, the filing date for your return.
Second, schedule the distribution to occur on a "special day" such as your birthday, your retirement date or some other special event so you'll know to be looking for the distribution. This additional step can help you avoid exposure to the tax penalty and give yourself something to look forward to receiving in the mail.
If you realize you have failed to make a timely distribution there is a process you can execute to potentially settle this matter. While there is no guarantee you'll avoid the penalty, it will at a minimum start the clock running with respect to the statute of limitations for imposing the tax penalty.
First, withdraw the money you failed to take from your IRA. Be certain of the calculation! Don't try amending your prior year return. It's too late for that. Second, complete and file IRS Form 5329 with your current year tax return or, if your return has been filed, file it separately, but DO NOT pay the tabulated penalty amount. Third, attach to the form a "request for a penalty waiver". The waiver request should explain how the distribution was missed. Some of the more likely reasons for missing a distribution would include, a) the custodian did not process your request in a timely manner, b) your request was lost in the mail and c) the taxpayer's spouse typically dealt with such matters and was ill or had died.
What should matter most is avoiding this outcome. Take the time now to minimize the risk of this happening to you. If you would like additional information regarding this subject please give me a call.
