Supreme Court Watch
The California Supreme Court has granted review of Network Capital Funding Corp. v. Papke, 23 Cal.App.4th 503 (2014). The issue is whether the trial court or the arbitrator decides whether an arbitration agreement provides for class certification if the agreement itself is silent on the issue.
