SB 800 Development

 

The California Supreme Court has denied a petition for review and request for depublication in Burch v. Superior Court, 223 Cal.App.4th 1411 (2014). 

 

This, along with last year's Liberty Mutual decision, allows homeowners to sue residential builders and general contractors both in common law tort and SB 800 theories.

 

These two theories have different evidentiary standards and different defenses, which will make the litigation of construction defect claims in California much more challenging.
