New Laws for the New Year

 

The law keeps changing, and it is important to stay informed of the latest developments.  Because California is considered a bellwether jurisdiction for the rest of the country, click here for a list of some new California laws for 2013.

 

President Obama signed the Strengthening Medicare and Repaying Taxpayers ("SMART") Act into law on January 10, 2013.  Among other things, it limits the Medicare Secondary Payer Statute by mandating that the Federal Govermnent has a three-year statute of limitations to sue insurance companies in conditional payment recovery actions.

Please note Jaynes Corporation v. American Safety Indemnity Company, 2012 WL 6720606 (D. Nev 12/26/12), wherein the U.S. District Court held that an ongoing operations Additional Insured Endorsement could provide coverage for "damages occurring after the completion of operations."

 

Please also note Nalwa v. Cedar Fair, L.P., 2012 WL 6734705 (Cal. 12/31/12), wherein the California Supreme Court held that the primary assumption of risk doctrine is not limited to sports activities, but can apply to other recreational activities (such as bumper cars at amusement parks) that involve an inherent risk of injury to voluntary participants.
