Supreme Court Watch

 

On December 6, 2012, the California Supreme Court issued its long-awaited decision in DiCampli-Mintz v. County of Santa Clara, No. S194501.  In an unanimous opinion, the Court reversed the Court of Appeal on the issue of how to comply with the statutory requirement of delivering a notice of claim upon a local governmental agency.  Delivery upon a county hospital's risk management department was deemed ineffective for purposes of complying with the explicit requirements of California Govenment Code Section 915(a).  Click here to read the Court's opinion.
