Late Winter Greetings from Colorado!

How can it be that we are nearly 1/6 of the way through the New Year, our Broncos were TOTALLY embarrassed in the Super Bowl, and the next national holiday will be Memorial Day?!  My, time does fly!

FREE: FASD 3-part Webinar series sponsored by SAMHSA FASD Center for Excellence and MOFAS
 
Learn about FASD from national experts. Feb 13, 20, and 27 from noon-1:30PM (CST). This series is designed for primary and behavioral health care providers, social workers, educators and other professionals who work with individuals with an FASD. Parents, caregivers and family members will also find the information helpful. CEUs available.

 

Legislation to Ban Seclusion and Restraint Introduced in The Senate

Senator Tom Harkin (D-IA), chair of the Senate Health, Education, Labor and Pensions (HELP) Committee, and Senator Chris Murphy (D-CT) introduced the  Keeping All Kids Safe Act.  The bill would ban seclusion and severely restrict the use of restraint on school children.  Senator Harkin also released an investigative report (upload from desktop and link) that found families often are not informed about the use of restraint and seclusion on their children.  Those who learn about the practices and whose children are harmed by the use of restraint or seclusion have little or no recourse through school procedures or the courts.  A main focus of the bill is to provide training to school personnel on the use of positive, supportive, and safe techniques when challenging behaviors do occur.

SIGN ONTO LETTER TO PROTECT STUDENTS IN RESIDENTIAL SETTINGS FROM ABUSIVE PRACTICES, RESTRAINT AND SECLUSION

Consider joining The Arc of Aurora and other organizations in signing a letter supporting a Congressional bill to prevent abusive practices and the use of restraint and seclusion in residential settings, including residential schools, behavior modification programs, boot camps, and wilderness camps. The bill will prohibit child abuse in residential settings; restraints that impair breathing; restraint and seclusion except in an emergency threatening physical danger; the withholding of essential medical care, food, clothing, water, and shelter; and acts of physical or mental abuse that humiliate or degrade a child. It will require schools to give students access to a telephone and instructions for seeking help. It will apply to children and youth in these residential settings if they have a focus on behavioral, emotional, or mental health issues and or a focus on alcohol or substance abuse. The first obviously includes students with disabilities. The bill applies to all children in these programs. SANE-SART Online Learning Program Sessions Scheduled
In 2013, through funding awarded by the Office for Victims of Crime, the SANE-SART Resource Service's Online Learning Program expanded to include special tracks for victim advocates, law enforcement, legal representatives, and crime lab personnel.  The next sessions are scheduled for March 3, April 25, April 28 and June 20, 2014.  After completing 32 hours of self-directed online learning, the student will attend an 8-hour webinar to augment the information provided online and allow learners to ask questions of a subject matter expert. This will complete the training requirement of 40 total hours. The webinars will be taped and stored online for others to review at a later time.

     To participate, complete the application form for your discipline posted on the SANE-SART Website.  The application asks if you are interested in assembling a SART team for a 2-day onsite SART Interactive Scenario, during which your team will take a sexual assault case from first report through a mock trial under the direction of our team of experienced SART professionals. If you check the box indicating you are interested, you will receive further information and a team application form. To be considered for this opportunity, your SART team members must represent four disciplines. Onsite training will be provided for three teams from each of the five U.S. regions. Participants will not be charged for training and will be reimbursed for any necessary travel expenses they incur, including airfare, meals, and lodging, to a maximum allowable level.  Direct questions to the SANE-SART Online Learning Program Administrator at SARTconf@comcast.net.

The Arc of Aurora is an advocacy-only (vs also being a service provider) Chapter of The Arc of the United States. We are privately funded, relying on our members and generous community supporters to provide individual and systems change advocacy, including publication of this newsletter. National Crime Victims' Rights Week (NCVRW)   is being observed April 6-12, 2014. This year's theme -- 30 Years: Restoring the Balance of Justice -- celebrates three decades of extraordinary progress made on behalf of millions of victims since the passage of the Victims of Crime Act (VOCA). This commemorative week has been set aside since 1981 to honor crime victims and the first responders, advocates, counselors, and others who assist them in their time of need, and the law enforcement personnel who work to bring offenders to justice. In response to many requests to provide the NCVRW Resource Guide earlier, OVC released the 2014 NCVRW public awareness posters and artwork online on January 20. The following materials, produced in both English and Spanish, are now available for organizations to incorporate the theme artwork into their outreach materials and other observance-related products.

Disabilities Website Helps Doctors Communicate with, Treat Patients

Site also meant as resource for patients, caregivers

A new website aims to provide primary-care physicians with tools for communicating with and treating patients with intellectual disabilities, defined as having an IQ of 70 or below. The website was created by the state Department of Intellectual and Developmental Disabilities, the Vanderbilt Kennedy Center for Excellence in Developmental Disabilities, and the Boling Center for Developmental Disabilities at the University of Tennessee. The website gives doctors guidance in how to interact with patients and assess their physical health and behavioral issues. The site provides checklists for problems associated with specific diagnoses such as Down syndrome.

"We are all human beings and we all have a right to live our lives without abuse."  Kecia and Molly call on persons with disabilities to work together, educate themselves and speak up to stop cycles of abuse -- be it financial, psychological, physical, sexual or domestic abuse.  Abuse of People with Disabilities: A Silent Epidemic is a public service video produced by the Board Resource Center to encourage people with disabilities to speak up about abuse.  Molly Kennedy and Kecia Weller are well known peer advocates in California who are taking a stand to stop abuse.

NY Mum on Thousands of Reports of Disabled Abuse

The agency established last year to protect the disabled in state-funded institutions has received nearly 25,000 reports of significant incidents, abuse, neglect and deaths in its first six months, though the public knows little about how many of those reports led to prosecutions, arrests and firings. Data recently obtained by The Associated Press under New York's Freedom of Information Law show more than 42,000 hotline reports from June 30 through early December, including 14,747 significant incidents that can include injuries, 7,506 claims of abuse and neglect and 1,904 deaths. Man Arrested for Abuse, Adult Autistic Son Malnourished

A Nevada man was arrested by Hurricane Police Thursday for alleged abuse of his 22-year-old autistic son, and on Friday the Washington County Attorney's office initiated prosecution bringing the charge before the Fifth District Court in St. George. Covington's 22-year-old son is autistic and unable to care for himself, relying upon his father and other trusted adults to do so, the probable cause statement filed in connection with the arrest stated. Woman Convinces Disabled Man to Give her $27K, and it's Legal

The FOX6 Investigators were recently contacted by a Milwaukee mom at her wits end, trying to protect her disabled son from financial ruin. The woman estimates her 45-year-old son who has cerebral palsy has given away nearly $27,000 in personal checks and cash since 2011. She says most of that money has gone to a Milwaukee woman named Carmen Lacey, who is a home healthcare worker. WISCONSIN (Milwaukee), FOX 6 NOW, February 6, 2014

Police Called to Arlington Heights Residence 7 Times

Seven times since April 2012 police went to the Arlington Heights home of a man and his girlfriend accused of using baseball bats to discipline his mentally challenged 25-year-old grandson. Jimmie Peterson, 68, and Michelle Thompson, 61, admitted to investigators that they beat Cherron Peterson with belts and bats, withheld food, and taped him to a wooden chair and locked him in a third-floor storage room, according to a criminal complaint. Judge Drops Charges Against Teacher Accused of Abuse

Deputy Arrested on Charge of Exploitation of Adult Dependent

A deputy with the Marion County Sheriff's Office was arrested on an exploitation charge Thursday afternoon. "The warrant was issued for acts or omissions allegedly occurring between 2005 and 2007, and involved an alleged endangered adult," a spokeswoman with the Marion County Sheriff's. Perfect Prey: Elderly, Sick Easy Targets for Abusive Caregivers

In Philadelphia alone, there are more than 73,000 residents with disabilities so severe that they require someone else to manage their annual Social Security benefits. The benefits are supposed to pay for food, shelter and personal necessities. Woman Accused of Throwing Hot Water on Disabled Man at Special Needs Facility

Photographs from the Lake County Sheriff's Office show the bandaged up burns of a 21-year-old man under the care of Carlton Palms in Mount Dora, a residential facility for special needs youth and adults. Richmond Woman Pleads Guilty to Abusing Disabled Adult, Child

A Richmond woman charged with battering a disabled adult female and the victim's child pleaded guilty Tuesday in Wayne County Superior Court III, court documents indicate. Karen S. Ward, 59, who has been free on bond since an initial hearing in the case in October 2013, is accused of having for a period of time, beaten and abused a mentally disabled adult female who lived with Ward. Catonsville Woman Indicted in Abuse of Disabled Resident

A Catonsville woman was indicted for abuse and neglect in the case of a developmentally disabled resident reportedly left in a hot vehicle in July, State Attorney General Douglas F. Number of Deaths Double for People in State Care

The Murfreesboro man says he never got an answer to the question of why his intellectually disabled brother choked to death while in the state's care. His concerns were echoed by relatives of several other deceased people whose care was entrusted to the state Department of Intellectual and Developmental Disabilities. The agency, already faulted for "serious problems" in a recent audit by the state comptroller's office, came under fire again last month. A massive report filed in U.S. District Court in Nashville under a longstanding consent decree details dozens of cases of poor and inadequate treatment of residents in Middle and East Tennessee. Largest Special Ed Settlement Ever! Child Abuse by School Staff 

The Antioch School Board approved a settlement of Eight Million dollars. Parents of the eight victims alleged that the special education teacher slapped, pinched, and verbally abused her students. The Antioch, CA school administrators failed to report abuse suspicions to the authorities. Some of the students were nonverbal children with autism in a Kindergarten class. The parents sued the district and five current and former employees. This appears to be the largest special ed settlement ever, having surpassed Steven Wyner's Manhattan Beach $6.7 Million case.

 

The Legacy of Ethan Saylor 

Exactly one year ago in a Maryland movie theater, a 26-year-old man with Down syndrome cried out for his mommy in the final moments of his life and started a movement. The death of Ethan Saylor at the hands of sheriff's deputies who were trying to evict him from the theater he entered without a ticket has become a significant event for people in the disability community who push for equality and inclusion as a civil rights issue. Ethan Saylor is their Emmett Till. For me, the Saylor story is deeply troubling and personal. My 10-year-old daughter has Down syndrome. She is witty and sunny most of the time but there are moments when she is obstinate and difficult - much like any child. But the behaviors sometimes take extra effort to work around. That kind of understanding and patience should have been afforded Ethan Saylor, who had an IQ of 40. Instead, off-duty Frederick County Sheriff's deputies were summoned to oust Saylor...
