Don't Let A Storm Become A Disaster:  Helpful Hurricane Hints

For many Americans, the Memorial Day weekend ushers in the start of summer.  For those of us here in Florida, it also ushers in the start of hurricane season.   No one can predict exactly how often or when or where a hurricane will hit, but the consensus from hurricane experts is that the 2013 hurricane season should be very active.
  
While even some active hurricane seasons pass with minimal damage to property, it is always best to err on the side of caution whenever you are in Florida. Seven of the ten costliest hurricanes in U.S. history have involved the Sunshine State.   Although the potential for property damage is always possible, effective emergency planning can help you weather the storm.
 
The first step to effectively prepare for a hurricane is to put together a comprehensive emergency preparedness plan. Part of that emergency preparedness plan should include how you will have access to storm information.  If a severe storm hits and power is knocked out, television and internet connections may be lost, and you may find yourself in the dark in more ways than one. An old-fashioned battery powered radio may be a wise investment so that you can stay informed of storm developments.  It is also recommended that you have an emergency kit on hand in case first responders are unable to get to you or a loved one promptly.

The Federal Emergency Management Agency suggests that you find out the elevation level of your property and whether you live in an area that is prone to flooding.  Many people focus on protecting their home from wind damage and overlook the damage that can be caused by storm surges and floods.

Another step in emergency preparedness that is often overlooked is the purchase of flood and wind insurance.  All too often, even here in Florida, homeowners fail to take this simple precaution that could prevent financial ruin should a destructive storm make land.  It is important to review your policy and make sure you have sufficient coverage.

Once a storm is imminent, it is important to make appropriate preparations.  Ensure that you have an adequate supply of clean water as water supplies may be contaminated for a period of time following a hurricane.  Along the same lines, it is important that you have stocked up enough food to last out the storm.  It is always important to secure your home and your property as best you can.  If local authorities recommend that you evacuate, make sure you have a plan that includes how you will leave and where you will go.  If you are unable to evacuate, identify a safe room in your home where you can wait out the storm.

Following a hurricane, it is important to check your home and property for damage.   In addition to flood damage and other property damage, check for gas leaks, cracks in the foundation of your home, or other signs of structural damage.  If you do have property damage, contact your insurance provider promptly to file a claim. What is the Federal Emergency Management Agency (FEMA)?     
A. FEMA is an agency of the Department of Homeland Security that is responsible for coordinating federal response efforts to natural disasters that overwhelm local and state resources.  FEMA provides disaster assistance in a number of ways including temporary housing, housing repair loans, debris removal, and flood insurance.

Q. What is the National Flood Insurance Program (NFIP)?
A. The NFIP is a federal program that was created by Congress in 1968 to help property owners protect themselves from the potentially devastating financial impact of floods.  Property owners in communities that partner with FEMA to reduce the risk of flooding are eligible for flood insurance. Q. Do all homeowner's policies cover flooding? 
A. This is a common misunderstanding.   Many homeowner's policies do NOT cover damage due to flooding.  Flood insurance generally must be purchased separately.  It would be wise to check the coverage section of your homeowner's policy to see if you are covered against flooding.


Q. What's the difference between flooding and rain damage? 
A. The government defines flooding as the overflow of inland or tidal waters.  This includes both storm surges and, more frequently, the flooding that occurs from the rapid accumulation of rain.  Rain damage occurs anytime that water leaks through the roof or walls.  A useful way to look at the distinction is that flooding is water damage that occurs at surface level, while rain damage occurs from water coming down from above.

Lay Witnesses Key to Resolving a Multi-Vehicle Tractor Trailer Collision   

Car Crash A husband and wife of 20 years were driving through Pensacola after attending a funeral in South Florida.  Having to bury a loved one is hard enough.  However, when this Midwest couple's journey home made it as far as Pensacola by way of Interstate 10 (I-10), their lives were inextricably changed forever.   

The husband heard the sounds of squealing tires and crumbling metal before he realized that he was going to be hit hard from behind and there was nothing that could be done to prevent it.  Moments later, his pelvis was broken in several places, his ribs were broken and his lungs severely bruised.  His wife laid next him in the passenger seat dizzy and confused having suffered a severe concussion and damage to her spine.  

The driver of the 18 wheeler couldn't stop his vehicle in time before careening into the stopped traffic ahead of him.  He only looked away for a second or two to send a text message before he realized the traffic ahead of him had stopped. Those few moments were enough to prevent the driver from keeping a safe lookout while operating his tractor trailer. Operating a vehicle without keeping a proper lookout is legal negligence-especially when that vehicle weighs 80,000 pounds.  

As a result of someone else's few inattentive moments, the husband spent weeks in an out-of-town hospital away from his friends and family.  After undergoing several surgeries and spending weeks in a Pensacola hospital, the husband and wife finally completed their fateful trip back home after attending the funeral in South Florida.  Their plans of retiring and traveling the country together were cast aside by physical therapy, doctors' visits, and the mountain of medical bills that were not covered by their insurance.    

These victims hired Taylor, Warren & Weidner to help them recover enough compensation to put them back on track to retirement and travel. The case was quickly mediated before litigation. The husband and wife were compensated for their medical expenses, their lost wages, and for the permanent injuries they will have for the rest of their lives.  The couple was provided fair compensation without having to deal with the time, expense, and uncertainty of litigation.  

The key to this quick resolution, said Phillip Warren, were the "lay witnesses who came forward to explain what they saw- they were key."  Oftentimes attorneys quickly hire expensive experts to try to "recreate" the accident to help explain what happened and more importantly what went wrong.  Although experts have their place, they can never take the place of a witness who actually saw and heard what happened with their own senses.    

Phillip Warren located and interviewed several witness to the accident. Internet searches
articles, photographs and even video of the scene were located. Mr. Warren also interviewed the couple's friends and family in the Midwest so that he could understand who these people were and how they were impacted by this unfortunate accident.  

Mr. Warren was able to compile this information and effectively present it to the truck driver's lawyers at mediation. Thoroughly obtaining all of the evidence at such an early stage of the case and presenting it at mediation helped convince the truck driver's lawyers the risk they faced if they did not come to terms with what happened.  To the credit of the negligent driver's lawyers who fairly evaluated their client's risk based on the evidence presented by Mr. Warren, all parties were able to resolve their differences and reach a compromised agreement. The case resulted in a substantial confidential settlement. The truck driver was able to get closure on a poor decision with devastating consequences. Most importantly, the couple can start to put this terrible experience behind them and move forward with their lives the best they can despite their injuries.

Bridget Esler    

Bridget
Bridget Esler is a Legal Assistant at Taylor, Warren & Weidner.  She is also our primary receptionist and is usually the first person with whom our clients speak. Hailing originally from Rochester, New York, she attended the State University of New York College at Brockport.  Ms. Esler also worked at a small law office while attending college.  

She interned with an events production company and was introduced to The Surviving Parents Coalition.  She has also been involved with the Ride for Their Lives - a national awareness campaign starting in New York and ending in California - which seeks public awareness and funds to help stop predatory crimes against children and young adults.  Ms. Esler was also a radKIDSŪ instructor where she helped educate and empower children to protect themselves from harm.

After college, Ms. Esler managed a group home in Long Island, New York, where she provided daily programs and services for mentally disabled women.  Ms. Esler was first introduced to the Emerald Coast area while visiting Destin on vacation.  She fell in love with the area, and relocated to Pensacola in July 2012.  Since she previously enjoyed working in a law office, she applied and was accepted for a position at Taylor, Warren & Weidner.  Ms. Esler says, "I take pride in working for attorneys who truly care about helping clients, and I am confident that they always work in the best interest of the community that they serve."
