Court sides with EPA on Chesapeake

On Monday, the U.S. Court of Appeals for the Third Circuit sided with the Environmental Protection Agency and affirmed the district court's ruling that the Chesapeake Bay TMDL is lawful under the Clean Water Act. In a 60-page opinion, the Third Circuit panel found that the statutory term "total maximum daily load" is ambiguous and that EPA reasonably interpreted that term to include not only a total allowable pollutant load, but also "allocations" of the total among point and nonpoint sources, timelines for states to put measures in place to achieve those source allocations and requirements that states provide "reasonable assurance" that those source limits will be achieved.

 

The panel rejected arguments by AFBF and other agricultural and home builder associations that the Bay TMDL (and EPA's interpretation of the statute) exceeds EPA's Clean Water Act authority and intrudes upon the states' primary authority over land use and water resources. In so doing, the panel repeatedly emphasized the act's goal of improving water quality, as well as EPA's role within the cooperative federalism framework. AFBF is continuing to analyze the decision.

Long time CC agency head passes
We regret to note the passing of our friend and long time Country Companies Pike/Scott/Calhoun Agency Manager Jim Maxwell. The family will hold a memorial service on July 18.

Ag Highlights SI Exhibit
Visitors get to see firsthand how innovation has driven American business as they walk through the four eras of enterprise at a new exhibit at the Smithsonian's National Museum of American History: the Merchant Era (1770s-1850s), the Corporate Era (1860s-1930s), the Consumer Era (1940s-1970s) and the Global Era (1980s-2010s). The exhibit shows the breadth of the American business story, and agriculture takes a leading role as one of the "five pillars" of enterprise, alongside consumer finance, information technology/communication, manufacturing and retail service.
2015 World Food Prize Announced

Sir Fazel Hasan Abed has been awarded the 2015 World Food Prize for his work to alleviate poverty in 11 countries around the world. Sir Fazel is the founder and chairperson of BRAC (formerly known as Bangladesh Rural Advancement Committee), which has worked to address the relationship between hunger and poverty. The organization noted that "BRAC's agricultural and development innovations have improved food security for millions and contributed to a significant decline in poverty levels through direct impacts to farmers and small communities across the globe."

TELSTAR IN ORBIT

 

Telstar was launched by NASA on July 10, 1962, from Cape Canaveral, Fla., and was the first privately sponsored space-faring mission. Two days later, it relayed the world's first transatlantic television signal, from Andover Earth Station, Maine, to the Pleumeur-Bodou Telecom Center, Brittany, France.

 

Developed by Bell Telephone Laboratories for AT&T, Telstar was the world's first active communications satellite and the world's first commercial payload in space. It demonstrated the feasibility of transmitting information via satellite, gained experience in satellite tracking and studied the effect of Van Allen radiation belts on satellite design. The satellite was spin-stabilized to maintain its desired orientation in space. Power to its onboard equipment was provided by a solar array, in conjunction with a battery back-up system.

Without your support, the Environmental Protection Agency will expand its jurisdiction over features like dry streambeds and ditches-features that were never intended to be regulated as if they are navigable waterways, under federal jurisdiction, with all the bureaucracy and expense that entails.
