As the paradigm shift of the Patient Protection Affordable Care Act (colloquially known as Obamacare) approaches, it's important for you to know that in 2014 individuals will have a choice of purchasing coverage directly through an exchange or working with your broker.
The rates will be the same in either case. When you let us assist you, you have an advocate on your side. We are learning all the complex implications of the new rules and will continue to provide solutions to your health insurance needs.

What Would Lynn and Gabriel Do?

Q: I was on Cobra with my company and had elective surgery in early March. I learned in late March that my company had closed its doors and I had no coverage during March. Can my insurance carrier deny my claims? Aren't I protected on Cobra? What can I do about this $70,000 bill?!
A: Here are some options that may occur to you:
- Sue your former employer. They had an obligation to tell you you were going to lose Cobra.
- Negotiate with the hospital. Ask them to give the discount they would have given the insurance carrier.
- Apply for one-time only Medi-Cal.
- None of the above.
None of the above.
Here are some basic facts about Cobra.
- Cobra coverage is contingent on the group having coverage.
- If there is no contract, there is no Cobra.
- You are eligible for HIPAA coverage.
- HIPAA coverage is fairly expensive but may be cheaper than your $70,000 surgery bill.
- You are still within the 63 day window for applying for HIPAA due to loss of coverage.
- Your HIPAA coverage with another carrier such as Aetna should cover the claim.

On May 14th, 2013 we will conduct the second session of our monthly updates on changes in health care reform legislation, new rules and how they impact prospective and current group and individual clients.
Every month this year until the beginning of 2014, we will host a presentation on the industry. Our goal is to increase your comprehension of all of the issues so that you can continue to make the best choices regarding your benefits.
The session will be on May 14th, 2013 at 9:00 AM in the conference room of our offices at 405 14th Street, Suite 204, Oakland, CA 94612. We're centrally located just above the 12th Street Oakland BART Station.
We can handle approximately 20 attendees for these sessions. They will be a great opportunity for you to get ahead of the coming changes of Health Care Reform and the Patient Protection and Affordable Care Act.

Multiple Plan Choices for Employees Through Federal Exchange Programs Delayed
|
According to a recent article in the New York Times, the Obama administration is delaying parts of a program intended to provide affordable health insurance to small businesses and their employees - a major selling point for the health care legislation.
"The law calls for a new insurance marketplace specifically for small businesses, starting next year. But in most states, employers will not be able to get what Congress intended: the option to provide workers with a choice of health plans. They will instead be limited to a single plan.
The choice option, already available to many big businesses, was supposed to become available to small employers in January. But administration officials said they would delay it until 2015 in the 33 states where the federal government will be running insurance markets known as exchanges. And they will delay the requirement for other states as well....
The 2010 law stipulates that each state will have a Small Business Health Options Program, or SHOP exchange, to help employers compare health plans and enroll their employees.
One of the most important tasks of the exchange is to simplify the collection and payment of monthly premiums. An employer can pay a lump sum to the exchange, which will then distribute the money to each insurance company covering its employees.
Exchanges are scheduled to start enrolling people on Oct. 1, for coverage that begins in January.... Insurers said that the administration was partly responsible for the delay because it did not provide detailed guidance or final rules for the small-business exchange until last month.
Businesses with up to 100 employees will be able to buy insurance in the exchanges. In 2014 and 2015, states can limit participation to businesses with 50 or fewer employees. Companies with fewer than 25 workers may be able to obtain tax credits for up to two years of coverage bought through an exchange. States can open the exchanges to large employers in 2017. ... The law makes it easier for consumers to compare health plans by defining four standard levels of coverage, ranging from the least to the most generous. The law says an employer can pick a level of coverage and then allow employees to choose among all the health plans available at that level."
As of this date Covered California is still moving ahead and successfully implementing multiple plan and carrier options for the CA small business market. This is because CA is one of a minority of states implementing our own Exchanges.
Remember, we will be appointed as official brokers with Covered California and will be able to guide you in the right direction and assist with any issues that may arise.
