What a great time to be Chapter President for CREW Palm Beach / Treasure Coast. The economy is better than it's been in years, tourism is up, construction is up, and vacancies are down. Multi-family is leveling off a bit, industrial properties are strong, retail is chugging along, and it's only a matter of time until we see some new office buildings break ground. Large tenants are surfacing in the marketplace, and it's becoming increasingly harder to satisfy their requirements.

 

So 2015 is off to a great start and business is poised to continue and intensify for the immediate future. CREW PB/TC is also poised for another year of growth, starting off 2015 well ahead of 2014 in member accounts. People do business with people they like, and our members are doing business together! Take advantage of these days like a squirrel storing nuts for the winter. Eventually these good times, too, shall pass, but let us all make hay TOGETHER while the sun shines!!

PAST PRESIDENT and COMMUNICATION CHAIR: JUDITH SCHUMACHER

For numerous members of our Chapter, the first quarter of 2015 has shown itself to be very productive!  (See news, below.)  Onward and upward seems to be the theme.  Commercial Real Estate activity is also trending towards mobility; as is multi-family and single-family development and construction.  Most Economist have predicted a productive 2015/2016 period of time, with leveling-out beginning in 2017. 

 

Local CREW membership is also on the rise and our YP (Young Professional) involvement is really exciting to note, as these members are the future of our organization.  Our upcoming Mixer with CREW Ft. Lauderdale/Boca Raton will be a great opportunity for our two Chapters to spend some time together.  Looking forward to the remainder of 2015, CREW PB/TC will host a panel of local Mayors; bring you an updated business overview from Palm Beach County's Business Development Board President/CEO, Kelly Smallridge; and insight into the South Florida medical/healthcare industry's effect on Commercial Real Estate.... Stay tuned!

Barbara LeBrun, Managing Director of KW Commercial Properties and President  of CREW Palm Beach/Treasure Coast,  quietly brokered a deal on a key property at 324 Dixie Highway at the intersection with Datura Street.  Purchaser David Associates reportedly paid $6 Million, under $100 per foot. The All Aboard Florida train depot proximity was a selling point for Lisa Gerard, David Associates President.  David Associates plan to invest capital dollars giving the building the renovations and the needed updates.  The market sentiment is that this sale got the ball rolling for the All Aboard real estate impact for the area.  This is just one of the many real estate deals that Barbara has successfully closed, since joining KW Commercial in 2013.




CREW PB/TC Past President and Communication Chair, Judith Schumacher, leads Women-Owned General Construction Company

 

Judith Schumacher, Owner/Partner of Schumacher Companies, actively joined the firm in March.  Having owned the company, along with her partner, since '08, she is now taking a leadership role, overseeing all pre-construction services and the company's growth in the South Florida region.  Judi strongly emphasizes her firm's 'open-book' delivery of construction services, offering clients the opportunity to better understand their project scope and costs.


 


CREW PB/TC Immediate Past President, Dawn Calder, moves up the ranks, at Regent Bank 

  

Dawn Calder, EVP Chief Credit Officer, with Regent Bank, was recently promoted to the position.  Dawn is responsible for managing the credit risk of the bank, as well as oversight of the loan administration and underwriting and managing special assets.

The Terrorism Risk Insurance Act extension was passed in the house on 12/10/14 and extended for another 6 years. Without the bipartisan support in both House and Senate many insurers would have been forced to drop terrorism coverage on their buildings policies. If the act was not extended it could have created loan defaults, since many lenders require terrorism coverage in their loan covenants and a current viable private sector marketplace for coverage does not exist.  



 


PROTECTING LANDLORDS FROM LIENS FOR TENANT IMPROVEMENTS

These days, commercial tenancies are complicated, and lengthy written leases are generally not an easy reference for the layperson when disputes arise. More importantly, despite these long-winded written leases (addressing seemingly endless "what-ifs") landlords would be surprised to know they may remain exposed to claims against their property where tenant improvements, which are typical under commercial leases, are involved. Specifically, even an airtight lease cannot protect a landlord against claims by tenant contractors who have not been paid unless that lease is accompanied by landlord action in the form of a recorded instrument. To avoid the nuisance and, more critically, obstacles to conveyance and collateralization presented by a contractor lien, Florida law has developed a framework comprised of two components: (1) ensure the lease has the necessary provisions; and (2) record a notice regarding that lease (or the property, depending on the case) in the public records.
